The police asking your name (and even demanding id) is not considered a search and never has been. This is true even without the checkpoint. Even if they'd just approached the douchebag on the street, they can still demand that he identify himself. I really hope that the dumbass was tagged with the border patrol equivalent of "interfering with an investigation". I do wonder about the purpose of the checkpoint. If they're just asking you if you're a citizen and then let you go if you say yes, do they honestly think the illegals are going to say no? |
We have those similar checkpoints here in San Diego. Some of the of the things that BP check for is the vehicle seem heavy, drugs, a tip that a vehicle is smuggling, just some along the line. There has been instance that a vehicle did not stop and wound up in a persuit. |
My personal favorite has always been coming into CA,you stop at the border checkpoints, and they ask you not if you're an illegal, or if you have a driver's license, but IF YOU HAVE ANY FRUIT! I totally get their need to prevent contamination and possible disease transfer, and I don't know of any other way to do it, but it just seems, well, fruity. |

SHOW ME YOUR PAPERS! I've seen Border Patrol stops in northern NY, about ~100 miles from the Canada border. I've always been kinda curious what the Border Patrol can do to an American citizen inside the borders since I thought government agents couldn't just set up roadblocks to ask you random questions "are you an american citizen? where are you headed to? why?" ect. I've also seen checkpoints around my city where police check inspections and registrations. My co-worker came up on one of these, didn't want to wait for the long line of cars, turned around, and won't you know he got pulled over. They had cop cars stationed at the nearest corners to pull over cars that turned around because it was "suspicious behavior" to not want to go through a check point.

![]() I have crossed almost every state border in the land. I have crossed state borders by airplane, automobile, bus, train and even once on foot. I have never on any occasion been stopped at a state border and asked if I had any fruits of vegetables, nor have I ever heard of it happening to anyone. |

It's happened to me once or twice. Second time I was in a Uhaul truck and the person in the other car had the key to the lock in the back. They just wanted to take a peek inside. It took 30 minutes but they weren't jerks or anything. If the kid in the back would have shut his piehole they would have been home free. |
BP checking for fruits? Hmm it's been state agriculture that's done the check. You are correct about preventing contamination or disease because it has happened here before and wiped out a good amount of crops. |

serious questions about this here: why were the BP agents unwilling to admit that the car/people were being detained? Officially, they *were* being detained, right? If not, then what is the point of having that BP there asking questions? Would an appropriate answer not be: "If you don't answer and/or prove your citizenship then you are being detained"? Are the BP's just stoopid and afraid to admit that they are detaining someone because they aren't fully trained or know anything about the law/rights/constitution/billofrights? Do they just need training on what exactly the law is and how to handle douchebags??? Or is this the same concept as LEO asking permission to search your vehicle and you responding with, "no since you had to ask that means you don't have probable cause"? Personally, I think that if LEO asks, then they dont have probable cause, and that you can say no. And if they honestly think you're up to no good they can detain you while they either wait for the drug dog or a warrant. In the BP case, if someone is being an ass at BP, they should immediately be "offically detained" Im all for the freedoms in the Constitution and Bill of Rights, but I also like the idea of keeping illegals out. Isn't this the same concept if a LEO stops you on the sidewalk and asks who you are and asks for ID that you have to comply? Or is that concept also being fought? On what grounds are these wackos going nuts about? just any law whatsoever? or do they think that these multi-stage BP checkpoints are just a step closer to a police state? If so, come on, its border patrol. someone from GOV needs to train these agents, and get them some tazers and mace |

WRONG...I cross it a few times a year and have done so for the past 6 years and haven't been through any check point.. HOWEVER, I do remember crossing it when I was very young, about 7 or 8 years old, and they had a checkpoint that did ask about fruit. Maybe its seasonal or maybe its history but I haven't seen it in a very long time. The BP checkpoints are all over the place around here, though mostly along I-8 in san diego and imperial counties. I'm assuming its because of its proximity to the boarder. It is probably easy enough to hike over and get picked up on somewhere but you need to take that freeway to get anywhere else so they have those checkpoints. Most of the time they don't even stop you. At least if you look white. |

That kid needs a beating. If, and when, we as a nation face any type of serious threat to our Constitutional rights, pussy's like this guy will do nothing. That's because he is all talk and not willing to stand up against folks who will drag him into the alley and club his ass. That's why he talks to these agents with no respect - because he knows he's safe. He degrades those of us who have actual concerns (which we can state clearly and respectfully) with certain aspects of modern policing/legislation/USSC rulings. I hope they tore that car apart and it took days. |

The agent was way too lenient with the smart ass punk. Hope he enjoyed his body cavity search. I've been through the same checkpoint and several others, i've never seen someone be that stupid. Aside from the usual citizenship question, one agent shocked me once when out of the blue he asked me if I had any dead bodies in the vehicle! WTF! LOL but we got a laugh out of it and he explained that last vehicle that matched mine did have dead bodies in it! |
