Hi, I was wondering if you buy a pistol from some one in a state that allows hi caps (pa) and your state does not allow them (NY)how does that work excatly? I know I should no this but it is somthing that I don't deal with often. I know I can buy them in NY with a dept letter head. thanks

I would think as long as you are an LEO and LEO's are allowed to own hicaps it should not be problem.

If you are buying it with authorization (Dept letterhead, etc) then it should be OK to send the magazines to you, otherwise they can only sell you the gun.

What is a "hi-cap" mag? 53 rounds? 95 rounds?

It must be more than the STANDARD CAPACITY magazine, which holds 15.

No actually in NY our so deady High Capacity magazines only hold 10. You better get your hand on some!

In california, it would be illegal to bring them into the state. But I don't know how they would tell the difference between magazines you brought into the state now versus those you might have owned for years. I know a number of people in California who bought high-cap mags for guns they don't even own before the law was passed - just for insurance that they would have them if they ever bought the gun down the road.

if you are a city cop then you need letter head to purchase from the equipment section.  nys law exempts you from high cap restrictions.  nyc should as well but when you retire city law does not exempt you at all from either prebans or post. state law exempts you from prebans but not post ban.

ref  art 265.00 of nys penal law.

i am not sure about adm law sect but pistol licensees were to be sent some notification about high caps in nyc
