| I don't really post to much on here but I have been a member/lurker for quite awhile now. Here's my question. I was planning on buying my girl a handgun for her birthday that is coming up in may, and she will be turning 20. We are both residents of Arizona so from a legal standpoint I know that I can give it to her because its classified as a gift, she just needs to understand the laws. However when I began to think about it more I realized something. That she has a DUI on her record, shes already gone to court for it and did a couple of days in jail (which was more or less a joke) and she is attending some substance abuse classes until june. Now at first I didn't really think about it but now I'm starting to think this could be a big problem. From the research I have done I have come up with some different answers. Things like convicted felons (of crime with a deadly weapon) can't posses a firearm. I want to try to stay legal on this because I don't want to get her or myself in serious trouble. But at the same time she is about to move into a place by herself and I want her to be safe. To make matters worse I'm stationed on the other side of the country. Please give me some insight guys! |
| Here in WA DUI is not a felony, so that is would not be an issue if it is the same in AZ. Also any felony conviction bars you from owning firearms, not just violent felonies. You may want to check on the specifics about her possessing a pistol and being under 21. In some states this is ok as long as you are on private or rented property, in others it is not ok. Bottum line it does not matter if the gun is intended as a gift or not, you live together and it will be registered to you. What you really need to find out is whether or not it is legal in your state for her to hae access to your weapons in your abscence. |

One other problem. Since you are not stationed in Arizona BATF does not consider you to be a resident of Arizona but of the state in which you are stationed. Here is a quote from the August 2004 BATF FFL Newsletter regarding residence of active duty military personnel: "The Gun Control Act (GCA) provides that a member of the Armed Forces on active duty is a resident of the State in which his or her permanent duty station is located." |
