Bernardo Tignor, 56, pulled a gun on the Opelika police officer who shot and killed him Saturday night, Police Chief John McEachern said today.
Despite McEachern's assertion the shooting was justified, Tignor's brother told the Columbus Ledger-Enquirer the family thinks the shooting was not necessary. Tignor's younger brother, Barnard, said the family has hired attorney Fred Gray and believe the officer, Jared Greer, could have waited for backup. "He got the best of the officer. ... They were involved in a fight, He actually beat the officer," Barnard Tignor said of his brother. "We are pursuing this issue with the lawyers," he said. McEachern, in a statement today, laid out what he says happened in the moments leading up to the shooting: At about 11:50 p.m., Greer, a 3 1/2 year veteran of the department, followed a vehicle from Williamson Avenue onto Marvyn Parkway and then onto Crawford Road. Greer attempted to stop the vehicle for a traffic offense -- the statement does not state the exact offense -- but it continued on until stopping at a private drive just off Comanchee Drive. The driver of the vehicle, later identified as Bernardo Tignor, attempted to enter a residence, but was detained by Greer. "Tignor refused to comply with the officer's commands, and began to resist the attempts by the officer to place him under arrest," the statement read. "At some point during the struggle, Mr. Tignor brandished a small caliber pistol. Officer Greer, fearing for his safety, drew his department issued weapon and fired multiple rounds at Mr. Tignor. McEachern told reporters Tignor has a record of approximately 20 arrests dating back to 1976 for offenses includeing assault, domestic violence, theft, car theft, fraud, writing bad checks, DUIs and menacing. http://www.al.com/news/montgomery/index.ssf/2015/11/opelika_police_shooting.html#incart_river_home Ahhh, the old I made it home, sprint to the door and you can't arrest me deal. |

The family will sue. They will probably lose (you never know with juries) but it will still cost the city a crapload of money. I wonder what they thought a backup officer could do?
