Despite McEachern's assertion the shooting was justified, Tignor's brother told the Columbus Ledger-Enquirer the family thinks the shooting was not necessary.

Tignor's younger brother, Barnard, said the family has hired attorney Fred Gray and believe the officer, Jared Greer, could have waited for backup.

"He got the best of the officer. ... They were involved in a fight, He actually beat the officer," Barnard Tignor said of his brother. "We are pursuing this issue with the lawyers," he said.

McEachern, in a statement today, laid out what he says happened in the moments leading up to the shooting:

At about 11:50 p.m., Greer, a 3 1/2 year veteran of the department, followed a vehicle from Williamson Avenue onto Marvyn Parkway and then onto Crawford Road.

Greer attempted to stop the vehicle for a traffic offense -- the statement does not state the exact offense -- but it continued on until stopping at a private drive just off Comanchee Drive.

The driver of the vehicle, later identified as Bernardo Tignor, attempted to enter a residence, but was detained by Greer.

"Tignor refused to comply with the officer's commands, and began to resist the attempts by the officer to place him under arrest," the statement read.

"At some point during the struggle, Mr. Tignor brandished a small caliber pistol. Officer Greer, fearing for his safety, drew his department issued weapon and fired multiple rounds at Mr. Tignor.

McEachern told reporters Tignor has a record of approximately 20 arrests dating back to 1976 for offenses includeing assault, domestic violence, theft, car theft, fraud, writing bad checks, DUIs and menacing.

So they're not even arguing any of the facts, just that the LEO "could have waited for backup"?

Hope that attorney got a retainer.

Sounds like the world is now inhabited by one less moron. Unfortunately, it sounds like his brother Barnyard is more than making up for the loss. Hope the department/city countersue for legal fees.

That guy is an idiot, I don't know what else COC to say.

And I absolutely love the people who think if they get home they won't go to jail. Or the ones who think if they just get to their house then the police can't impound their car.

The new reality with the agitator in chief in the White House.
Pulling a gun on a LE is not justification, they could have just ignored him.

LOL good shoot. Too bad the brother didn't get hit by the same bullet.

Good shoot and I hope the officer gets all the backing he deserves.

Hopefully this will end as it should and the officer (and his family) will be fine.

So, when do we get to roast marshmallows after the BLM burns Opelika?

I'm relatively close, but I'm guessing we should show up after Sunday brunch.

I find that shouting "I KNOW MY RITES" and "YOU CAN'T DO THAT" is also quite effective.

Not quite.

The new recommended procedure upon facing an armed suspect is to wrap your head with a towel so that you cannot see him, and hope he has the wits of the Ravenous Bugblatter Beast of Traal.

Correct. The bad guy has to shoot first. At least that's what I've been told by several bad guys.

Simply pointing a gun at a police officer and saying you're going to kill him is "Freedom of Speech."

I've seen that ROE for LEOs suggested by people here in GD.

The family will sue. They will probably lose (you never know with juries) but it will still cost the city a crapload of money. I wonder what they thought a backup officer could do?

The lawyers who represent these bullshit cases need to be made to start paying the legal fees for the defense when they lose. Maybe if they were held responsible there wouldn't even be these monumentally stupid cases in the first place.

Which contradicts GD's belief that all cops are Barney Fifes who know nothing about guns, never train, and can't hit the broadside of a barn.

Thats as bad as "he could have shot him in the leg" or the " shoot the gun out of his hand" idiot family members that often make statements in these stories.
