Does anybody carry their own personal liability insurance?  I hadn't really given much thought to it until this past week when we had two officers are our department sued individually without naming the city.  It is a federal civil rights violation law suit and I don't really think it has a chance, but its got me thinking none the less.  I'm not really sure what the departments or the cities responsibilities are to officers if a law suit dosen't name the city or department as a defendant.  Anybody that can enlighten a bit?  Is a personal liability umbrella a good idea?

How does one know they are a professional? When they start carrying liability insurance.

Carry it? Yes.......but not for LE purposes. So the following is a side point to the question.

Okay, two basic things about insurance. First of all, the more one is insured, the harder someone will fight for the insured in court if that person is sued. It's a painful kind of sense. If the company stands to lose $10M as oppose to $1M, they are going to work harder. Of course, they may drop the insured afterwards.........it could be a one shot deal.

Secondly, at times, I've seen offers for my insurance to be a policy with the organization; hence, lower payments by me. There is, of course, a catch. The work that the insurance covers can only be done at that organization. So, I've never gone for that kind of deal although I currently only do such work for that organization. Why? In my personal viewpoint, I want to remain marketable which means having such necessities mobile with me.

If you are getting sued civilly for something that happened while you were working for an LE agency, and the LE agency indemnified you for yer actions, then regardless of if the city or agency itself is named, you are covered by their unbrella!  We get folks named individually all the time and the county's lawyers cover them and the county foots the bill.
