So, most people think Ohio became a state in 1803, with a political compromise to settle the border with Michigan by giving Michigan the UP, and giving Ohio the Toledo Strip.
This is wrong. In 1953 it was discovered that congress never actually finalized things in 1803. So congress retroactively fixed that. The problem is that is Ex post facto laws are entirely unconstitutional. At minimum Wisconsin should get the UP back, Michigan should get Toledo. Logically, Ohio should just be a territory of Virginia again. |
