Ok heres the story....I sold my car(a highly modified motor and car) to my cousin as is with no warranty expressed or implied. I tried to tell him that a high output car like this will have problems and will increase in maintenance if it is raced.  Well 2 weeks later I get a call from him saying the car is in flames.  He said he was doing 4500rpm in 4th gear(transfers to 100+mph) and climbing when flames came out the bottom.  He got out and the car burn to the ground.  He then has the nerve to call me (sat night 2 weeks after sale) and ask me if I still have insurance because its on fire and he didnt cover it.   I said no of course not and if I did It would increase my premiums.  Anyways he quits calling for about a month and tonight out of the blue I get a call from him asking me to meet him halfway with the price to help out. I calmly(I dont want to tread on family) Told him that IT was sold as is and explained that I warned him about racing.  He kept pretty calm but was still insistant on some help.  What really toques me is that his buddies are in the backround(all mong) telling me to come and kick my ass.  This doesnt bother me to much but makes me uneasy since they are all believed to be drug users.  

He also(not that this mattered but was trying to side with himself) that Minnesota dealers have a 30 day lemon law.  This is not the case with privately sold used cars though I wouldnt think.  

I hesitated to sell the car to him in the first place and had another buyer to pick it up had he not taken it.  I didnt want to ruin family although we are not that close but I dont want to be treaded on.  It wasnt my place for him to insure the car either so not my fault he is out the full $10,000.  So just some feedback would be appreciated.  I am not worried for my safety(good ol AR)  but dont like thinking that I have enemies.   Whats your guys feedback.

What kind of car was it? I bought a rototiller that blew up 2 hours after buying it and got my money back but that wasnt $10k

Tell him that he should of insured the car, and he wouldn't be having this problem now.

The guy's an idiot - and you owe him NOTHING.     I freakin' HATE it when people try to make others responsible for their stupid behavior.



Not sure what to do about his loser buddies.  If they threaten you, definitely file a complaint/get a restraining order.  That way if it ever does come to blows, you'll have a paper-trail showing that they were the agressors.  I dunno - probably not verry useful.

I would think that privately sold cars don't adhear to the lemon laws either. What's he gonna do tell the police or a lawyer that he caught the car on fire illegally street racing or he was driving a car without insurance. If he keeps that shit up the next time he calls straight up tell that if he persists calling you, you will get a lawyer and have this settled once and for all.

Besides that is one family member I wouldn't mind cutting out of my life, that's just me. You must be a bigger man than me I would have completely told him and his druged up fuck heads where to go.

Conclusion:  ( based upon your side of story)

Dumbass buys car from family member, doesn't buy insurance, conducts illegal street racing, burns car to the ground, then demands family member who sold him the car to pay at least half.?!!!!
His problem not your's my friend.

Ask him to report to the police that he was driving without required insurance and that if he thinks that he really has a case to go hire a lawyer and you'll see him in court.

The guy is a dumbass times a thousand.

Don't sell cars, electronics, or appliances to anyone you are related to or know. Everything else should be avoided unless they insist on giving you too much money.

It was a 95 mitsubishi eclipse with about $20k into it.  

Ya I know I am ok with everything but  I dont like aggressors since Im a really laid back guy that doesnt cause trouble,  I just told him that It was sold hesitantly to him in the first place and that had he not taken it another buyer would have been there with $500 more but since he spoke first he got the car.  

I would hope he doesnt try anything stupid but with the stuff that they might be on who knows.  I will take the steps in protecting myself if need be.   Thanks for the encouragement and I guess Im trying to stay calm and not yell back to provoke him furhter.  I also charged up the ol tape recorder to record the conversation in the future in case any threats are made.  I have a concealed permit althought I dont have a piece but my AR is at my bedside in wait although god forbid it comes to that.....

The problem about dealing with certain groups such as these is that they are tied to other poeple who know other people and unless you kill the root you are going to have even more weeds

I did everything I could to possibly discourage him but he was persistant and had spoken first so I didnt want to shut him out for fear that he would be pissed and hold a grudge about that .

I just gotta stop worrying about other peoples shit haha

His mom was killed by a drunk driver when she was younger and had very good benefits at her job(mayo clinic in Rochester, MN) as well as a huge settlement from the driver that provided the buyer of my car with a large trust fund.  He crashed his first car(98 GTP) with no insurance before this and also blew up the last motor in his 91 eclipse gsx so he knows what its like to be stupid

actually he said that he didnt transfer his part of the title. However I took my part and did it as soon as he left the driveway.  This transfers me away from any responsibility. I also have the bill of sale and my part of the title since I did it on line

If I were you, I'd buy a little something for that permit!! You did say his friends are drug dealers, don't mess around. The AR at your bedside, will do you no good when your on the road. Does he know you have an AR??

No he has no idea what I have or for the most part were I live.  He is about 6 hours away so Im not real concerned but I dont have money to throw down on a new XD .40     Like I said I think he was just fishing for some help on the situation but still want to keep myself and g/f safe.  She is home for the summer so no problems and like I said Im blowing it out of porportion even worry about this stuff but just in case ya know.......
