ATF says it's only a VFG if it's "90° to the bore," and now B&T does too. Behold their latest USA civilian legal PISTOL configuration. 
Therefore, these are also not VFGs 
After all, this is a perfectly legal pistol

I mean, its not plumb, but couldn't you say that its 90 degrees to the axis of the bore when viewed from the front, or is it kinked off to the side as well?

Can it be 89.9999999999 degrees?
What part of it do you use your protractor on, the front edge, rear edge or base? What if it's canted to the side? What if you have vertical foregrips? Foregrips are not a foregrip.
