MEXICO CITY, Jan 4 (Reuters) - The U.S. Border Patrol used a "dum-dum" bullet, banned in international war but standard issue for border agents, to kill an 18-year-old undocumented Mexican immigrant whose death last week angered Mexico.

The hollow-point bullets, designed to expand on impact, cause much more tissue damage and bleeding than standard rounds.

A Border Patrol spokesman said on Wednesday the bullet fired into Guillermo Martinez after he crossed the U.S. border near San Diego on Friday was a .40-caliber hollow-point round.

The ammunition is banned in international warfare under a century-old treaty but is standard issue for the Border Patrol and some U.S. police departments.

"The agent in question was carrying a .40-caliber Beretta ... a .40-caliber round," Nicholas Coates, a spokesman for the Border Patrol's San Diego sector, told Reuters in a telephone interview.

Coates said the bullet fired was hollow-tipped and that "all Border Patrol agents carry hollow-tipped rounds."

The ammunition is banned under the 1899 Hague Convention, which prohibits use in warfare of expanding or fragmenting bullets, generally referred to as "dum-dum" rounds after an Indian arsenal where they were introduced in the 19th century.

Mexican rights groups and witnesses said Martinez, who had crossed into the United States with three other men including his brother, was shot in the chest.

He managed to walk back over the border to Mexico and was treated at Tijuana's Red Cross hospital. Surgeons operated on him twice, but he died the next day.

Mexico this week called for a formal investigation into the shooting, which came weeks after a U.S. lawmaker proposed a plan to fortify part of the U.S.-Mexico border with a high-tech wall to stop illegal immigrants.

The Border Patrol said the agent shot Martinez after the Mexican had twice hurled rocks at him. The unnamed agent has been placed on administrative leave pending the outcome of an investigation.

Each year, an unknown number of Mexicans attempt to cross the deserts and rivers marking the 2,000-mile (3,200-km) border in search of work in the United States.

The Border Patrol arrested almost 1.2 million undocumented immigrants making the journey last year. At least 464 died en route, many from heat exposure.




The mexican government is giving press releases saying that it was unfair to shoot someone with a working bullet.

They even have a cute name for it "dum-dum" (well that is not new, but I do not think anyone has used that word in at least 50 years)

I could not find that Mexico was participated in the signing of the Hague Convention, but if they were, and they are now complaining that we are using expanding ammunition, this amounts to a backhanded declaration of war.  The Convention explicitly states "The present Declaration is only binding for the Contracting Powers in the case of a war between two or more of them."  

Therefore, if they are asserting that we should be following the guidelines set forth in this treaty, it follows that they are recognizing the state of war between themselves and the US.

I also found the whole Geneva convention/warfare thing funny. Last I knew, neither country had a written war declaration out. The mexican's are really grasping at straws with this one.

Correct me if I'm wrong (and could very well be) but I don't think the U.S. signed the Hauge watchamacallit. If not then it should'nt apply anyway. Besides the BP probably carries the same type of ammo your local friendly LEO carries.

I agree. A .40SW "dum-dum" is inaddequit (sp).
The agent should have been equipped with a belt-fed 40mm auto grenade launcher.

Expanding projectiles aren't needed in that case.

No, I think its very, very true.  I won't say why, but I will say I have first hand experience dealing with folks who cannot read or write (Americans and Mexis) and trust me, many of the Mexis cannot read Spanish let alone comprehend a word of English.  

They do seem to understand Policia or whatever the Spansih word for police is and INS.

I heard a story from a BP Supervisor once, of how an illegal took a pot shot at two BP Agents from 90 yards....they returned fire with M4s loaded with ball and tracers, each fired 30 rounds or so, hit him a dozen or more times.....and he still crawled back and died on the Mexican side.

That story should be more common than it is....
