I was just coming back from my moms house driving about 60mph in a posted 55 zone...when some jerkoff behind me is really riding my tail in the second lane of the highway.  This usually is not a problem but we are coming close to where the highway merges into two lanes....The guy wont pass and he is within inches of my bumper on the left side of my car....at this point I realize that I should increase my speed a little to put some distance between me and this possibly intoxicated driver....

Just when I get up to about seventy miles an hour a car starts coming in my opposite direction and I see the outline of overheads behind my car.  About 1/8 of a mile further up the road I take the exit and I am immediatley lit up.

I keep both hands on the wheel and wait patiently for the officer to meet me at my window....after he makes his introduction I calmy tell him that I have a valid CHL and that my firearm is on my right hip at five o'clock and my wallet with all of my info is in my left butt pocket....

Cop says "hey not a problem, I already know..but I really apreciate you letting me in on it."

He tells me he pulled me over because I was cruising around seventy and I was hugging the right line...

his attitude is pretty good so I tell him exactly what I thought....

"officer, I thought you were drunk...and there was no way in hell I was gonna let you knock me into incoming traffic, 'cause you were riding my ass pretty damned close"

The officer just laughed...checked out my documents...and told me to have a nice day, and that its not very often he runs into a young man with a good sense of humor who is honest"

All in all I think it went pretty damn well....my dog is still alive....and no speeding ticket....

Yes there is.  You got to give them a bath.   In the above freezing months (about 9) I keep water only in my winshield washer tank.   Anyone within 10 feet of my bumper gets a full tank of not stop mist back at them.  The most enjoyment I get is to wash people with really shiny just washed/waxed cars and spray them, or get infront of and spray anyone with a kerry/edwards sticker..

Glad all went well... as it probably does more often than not if you're a CHL holder.

BUT - A guy I work with sometimes was pulled over by a Sheriff's Deputy in a rural Texas County and when he identified himself as a CHL licensee and told the deputy his pistol was in the console between the seats (as required by Texas law), the deputy ended up having him stand there on the side of the highway for over an hour.... with a DPS officer, and two Border Patrolmen as "backup" while they ran some kind of check on the gun's serial number "to make sure it wasn't reported as stolen".

What bullshit.

When the number came back clean, they turned him loose and the deputy said it was the first time he'd ever stopped a CHL holder.

I know the next question you have is: "Well, did your buddy look like a scumbag?"

No.  He's a 40yr old guy who owns his own business and was driving a nice clean 4WD 2003 Ford Excursion - not exactly the profile that I would guess sets off alarm bells with LEO's.

Oh well, I'm glad they're not all dumbasses.

Consent Searches

Schneckloth v. Bustamonte
412 U.S. 218, 93 S.Ct. 2041,
36 L.Ed.2d 854 (1973)

Officer James Rand stopped a car with six occupants and received consent from the driver to search the vehicle. It was determined that the officer did not pressure the driver into consenting. In the back seat he found three checks which had been stolen from a car wash. Defendant Robert Bustamonte challenged his arrest, arguing that while he had consented voluntarily, he had not been informed of his right not to consent to the search.

In Schneckloth v. Bustamonte, the Supreme Court ruled that consent is valid as long as it is voluntarily given. The ruling held that police may not use threats or coercion to obtain consent, but that they need not inform suspects of their right not to consent to a search. In reaching this decision, the Court rejected the stricter “waiver test,” which holds that suspects must be fully informed of their Fourth Amendment right against unreasonable searches and seizures before they can give valid consent.

What you should know about consent searches:

As demonstrated by the Court in the Schneckloth ruling, the police are under no obligation to inform citizens of their Fourth Amendment rights when requesting to perform a search. This means it is up to the individual to understand and exercise their right not to be searched. Some states require that police obtain the citizen’s signature on a waiver form before conducting the search, however in most places police merely need to obtain the citizen’s permission verbally. This can be a tricky situation because police will sometimes interpret a broad range of statements or actions as implied consent. Here’s what you should remember about police search requests:

  1. According to the Fourth Amendment, you cannot be searched without a warrant or probable cause, unless you consent. Don’t consent to warrantless searches.

  2. The officer cannot “make things easier” for you if you consent. Consenting makes it easier for the officer to arrest you

  3. If you consent to a search, any evidence found can be used against you in court.

  4. If you don’t consent to a search and the officer searches you anyway, your lawyer can get the evidence thrown out in court.

  5. You cannot get in trouble or become a criminal suspect for refusing to be searched.

  6. The officer cannot detain you unless he has reasonable suspicion to believe you are involved in something illegal.

His friends were driving around one day and just for kicks asked him if he'd like to drive.  He drove for a few minutes on quiet suburban streets when a cop, noticing the vehicle moving in a somewhat erratic manner (though my friend was being coached) pulled the vehicle over.  Said friend just turned his whited-out eyes vaguely at the direction of the cop and grinned.

Cop said.... "UHHHH ok.. well you'd better not drive any more"... and that was that.

hehe happy to play... The above mentioned case the 'waiver of 4th' was granted, so that case laws is useless for comparision. your number 1 point...reread it

1. According to the Fourth Amendment, you cannot be searched without a warrant or probable cause, unless you consent. Don’t consent to warrantless searches.

<Terry v Ohio ; Pennsylvania v. Mimms> .... With resonable suspicion <burden of proof is always articulable cause> I can remove you from the vehicle, perform a pat down search, <Michigan v. Long> and search a good portion of the passenger comparment.

If I have/find PC whilst your vehicle is anywhere I may lawfuly enter,<United States v. Ross> <Texas v. Brown>< Colorado v. Bannister> I may search it completely, with due diligence. With or without a 'consent to search'.

To save you some time... research warrantless searches <make sure you understand the mechanics of 'limiting scope' of a warrantless search> and case law referenced above also a search of 'Terry Stop' may be enlightning.
