becareful.. I ran in to a fella at the Drag strip a while back the told me wht he had.. he was in the Army......several months later met up with him to go to the drag strip and viola he had exactly what he said......Needless to say I dont play with that guy any more...."he had now Idea what a tax stamp was"

Mp5s are not banned.But they are controlled, and must be registered at the Federal level to be possed legally.As in NFA registered machinegun,with attendent,and required documentation of ownership such as a BATF form 4.

You can buy an MP5 or other machinegun legally in most states.  Problem is to get a civie legal transferable machinegun, you had better come prepared to shovel out some serious coin.  MP5's are currently in the $12,000 price range and increasing rapidly.  The manufacture of machineguns for civie possession was banned on May 19, 1986, but the law grandfathered those that were already properly registered - essentially, the ultimate "pre-bans".  See the M16/full-auto forum for more info.

I have a guy in my reserve unit who's "cries for attention" manifest themselves into owned gun claims. Says he has an MP5, and an SA80. He's full of shit, but pretty harmless....

If the barrel is less than 16in than it is still han NFA gun. They are in the $2000 or so price range for a SBR MP5, and those still require NFA paper work. He could have one. Plus is it an actual MP5 or one of the many clones that are out there. Though that really only plays into price and some reliability issues.

I don't know CA law, but I think Mike45acp is probably right if its in CA. The semi-auto carbine is known as an HK94, but there  are other manufacturers now making cheap HK94 clones.  Unlike the MP5, the 94 and clones are (obviously) semi auto only and have a 16" barrel rather than the short 8.9" or so of a true MP5.

Being an Hk nut also, I can tell you a bunch about the SMG if 'guy' divulges any more specific details.

Single fire MP5's are not 'standard' persay;  most in circulation have Select fire groups of varying burst capability.

A single fire FGC fitted to an MP5 would have been an after thought.

Being that you're in Kalifornia, I'm hard pressed to believe the legal possession of a true MP5.

More than likely, he has a long barrel HK 94, which is the Carbine 16" version of the MP5;  There are much greater numbers of these in circulation, and tend to be easier to 'arrange' in non-gun-friendly states.

The first question you should ask him is how long it took him to Class 3 the weapon;  you'll know right away if he's talking out of his butt.

If it's not properly Class 3'd (and we all know how long it REALLY takes to get that sort of thing) then more than likely it's either a 94, a SW clone, or it's not a real firearm.  (you'd be surprised how many chumps try to pass off Airsoft replicas as real steel.)

Obviously, proof is in the pudding;  Ask for him to show it to you.

Then subvertly search for the Class 3 engraving.  If he can't show it to you, run like hell, and never talk to him again.  

(and never admit you saw the weapon)

There were two semi-auto "MP-5s" that were available to civilians.  The SP-89, which I believe was made by HK, but stopped production/importation in the 80s.  Now there's the SW-89 which I don't think is made by HK, but is a copy.  See here: [url]http://www.facamerica.com/010.asp[/url]

The SP89 is not classified as an MP5, as it has no stock, and is sold under the PDW or Pistol class of firearms. (as is the Special Weapons SW89)

The addition of a stock to an SP89 or clone, immediately requires SBR filing, as the stock and increase in weight has now crossed the pistol into SBR territory.

As I said, everyone likes to brag what they have;  proof is in the pudding.

I can buy a shit load of Yugo and Polytech AK's and bump fire the shit out of them!

I was at the last Great Western show back in Dec 99 with a friend.

We saw this guy carrying around a DSA SA58 and a MP5 style gun.

The guy selling them told us it was an HK civi version something or other.

Now, I did hold it and fondle it a little, but I cannot confirm it was made by HK.He was asking 2,500.

My friend bought the DSA for 1,000.He's even a member here so he can confirm we both saw this animal.

I just came back from lunch and ran into him in the main court yard. He had a digital camera with him and on it was an MP5. Not the one with the 16" barrel. He said he bought it back in 1992. Is this thing legal?

There is no private ownership of true MP5's as marked on the top of the receiver. AT BEST he has an HK94 or SP89 with a auto-sear done by Flemming or Vollmer. Either way, its not a TRUE MP5 and they are NEVER as reliable or long-lived. You have no idea how often these bastard MP's fail. Basically he's full of it.
