"Trial starts in Buckeye dog-abuse, sex case
The trial of a Buckeye man charged with animal cruelty has gotten under way, nearly 14 months to the day after he was arrested.
Douglas Robert Burns faces two counts of animal cruelty stemming from the January 2004 discovery of photographs that showed the 51-year-old man performing sexual acts on his dogs.
During the second day of the trial, which began March 7, defense attorney Kristen Curry told the jury that “the sexual nature” of Burns’ acts “has nothing to do with animal cruelty.”
While state prosecutor Anthony Church conceded that bestiality isn’t illegal in Arizona, he said the cruelty charges stem from photographs that allegedly
depict Burns penetrating at least one of his four dogs with a rubber mallet.Speaking from the witness stand March 8, veterinarian Nancy Bradley confirmed that the use of a mallet in a sexual manner would indeed qualify as cruelty.
“Depending on the size of it, I would think it would be a painful event every time — unless the animal was sedated or restrained,” she said.
The case unfolded on Jan. 8, 2004, after employees of a Wal-Mart photo lab told Maricopa County Sheriff’s Office officials
they’d developed photographs of Burns performing sexual acts with dogs. Investigators said they believe Burns’ wife, Carlotta, was the camerawoman.
Detectives from the sheriff’s Animal Cruelty Investigative Unit then searched Burns’ house,
where they found more pictures of him performing oral sex on a male dog and engaging in intercourse with a female dog.In a statement issued shortly after Burns’ arrest, Sheriff Joe Arpaio said, “This case puts a whole different spin on being a dog lover.”
