Okay... I'm a Florida LEO and I can carry off duty without a CCW (I have a CCW anyways). Also as a LEO I'm allowed to carry in places that I would not be if I only was a civilian with a CCW.

My problem is that I'm starting college again in the fall. I need to finish my degree if I ever want to go and be a FDLE Agent or go Fed in the future. Anyways, as a Sworn Florida Certified Law Enforcement Officer, can I carry off duty in college? I've looked over ever Statue in Chapter 790 and cannot find a single thing. I don't want to go ask my SGTs and LTs for fear of looking like a idiot.


I'm Just trying to find the statue that covers LEOs and off duty carry of a firearm. 790 covers some of it but not all and I can't find the rest.... sucks being the new guy.

There shouldn't be an issue.  Espicially if the college is in your normal juristiction.

Keep in mind a few things:

LEOSA allows you to carry anywhere except certain government buildings and private property where the owner does not want you to. If the school is private, the most the administration can do is ask you to leave the gun in the car. I am fairly certain that LEOSA does not specifically prohibit carry at government owned schools.

Also, check 790 for the language that states something like "nothing herein shall apply to LEOs. I can't remember exactly where it is, but I know it is in there somewhere.

Also, in my county, even if you are a city cop, you have countywide jurisdiction based on standing agreements. I think it is the same in Dade. If the school is in your county, this may be irrelevant.

Good luck in your decision to go state/federal, but I know several FDLE agents that don't make anywhere near as much, or have benefits as good as many of the SoFLa agencies.

Thanks... I know that LEOSA has nothing to do with me carrying state wide. Florida laws states that. As for carrying on school grounds (Public University/Government Run) Cahpter 790 says nothing if a LEO is restricted. There is a section for off-duty carry but it simply states that a LEO may carry concealed without a state CCW permit.

Florida CCW Permit Holders cannot carry in a bar but an off-duty LEO can. I just still can't find anything about college/university.

I know a couple of FDLE people also. It's not pay that interests me, its the fact that they're FSR Retirement, Statewide Jurisdiction, and Permanent Investigators. Many City PDs in South Florida don't treat Detective/Investigator as a rank. They treat it as a position. So if you get bump up to Sgt or Lt, you go back to uniform patrol. You lose your position as a Detective/Investigator.

No way you can be arrested for it. LEOs are exempt from the CCW prohibition, under State and now Federal law. If you gave more than a brief thought to leaving your gun at home in South Florida you need to hurry up and get that detective job before something bad happens and you need to shoot someone. Going FED is moving backwards.

FS 790.051 LEO exempt from licensing course n scope of duty.
FS 790.052 LEO off duty with dept permission
FS 790.06(4)(b) LEO exempt from licensing requirments of the chapter, IMHO this includes the restrictions placed on licensees,(like carrying your gun into your police department) (15) "this section shall be liberally construed to carry out the constitutional right to bear arms for self defense and nothing in this section shall impair or diminish such rights."

No it dosen't say anywhere you can carry your gun on campus...but you can.  
Just do it. If you get into a shooting on campus you really won't care about much else other than the fact you didn't leave your gun at home. No part-time sheepdogs!

I did when I was going to school in NC, I just didn't tell anyone, and no one saw it. The school may not like it, but legally as far as I can tell your clear. You may want to ask your DA, FOP, or union rep if you have one.

Just a thought in case you folks havn't thought about it. Even if your an LEO you should get your CCW permit if available.
 
Lots of reasons:
1) you get suspended for a BS complaint, we seize your ID, BOND Card, weapons and vehicle ASAP. You won't get them back till your cleared could be weeks. Could pose a problem to carry concealed when your ID's been seized and when someone calls to check and your suspended.

2) Don't want to carry your badge with you for some reason, outside or even inside your jurisdiction. Several reasons this could come up.

3) You get hurt and placed on light duty. I had a non cop write a up light duty restriction prohibiting me from carrying issued weapons or driving a marked car, and avoid physical confrontations unless someone's life was in danger. I guess this person thought I was just going to stop being the police cause I tore my knee up, my trigger fingers were fine! I carried my own weapons and drove my own car to my non uniformed light duty assignment. A few months later we shot and killed a armed suspect 25 feet from the entrance to this "light duty" assignment. Glad someone had a gun. I guess I could have hit him with my crutch as I walked in to work.  

4)  You finally get fed up call dispatch and tell them to sent a contract tow to your house to tow the government car and all associated equipment out of your drive way cause you quit. With your CCW permit you can still go right back outside armed able to protect yourself and your family.

You should get them for your entire family if old enough. The wife of the Sheriff of Jackson County FL was recently targeted for what appeared to be a revenge attack. The Sheriff's wife, and the first reponding Deputy died. The only saving grace to this incident was both suspects were sent straight to Hell in the erupting gun battle with additional responders and the Sheriff himself. His wife was ambushed while alone but was able to call for help. Our families and loved ones are by default part of our warrior class and deserve all the protections we can afford. My son, daughter or wife may be in one of your classes and I expect you to do more to protect them than soak up a bullet. PLEASE for the rest of your career NEVER EVER EVER LEAVE HOME WITHOUT IT.


My squad of 14 only has one guy carring a backup aside from me. Many I've even caught off duty with their badge and no gun. Every time I see them I ask where their gun is. My relentless shaming makes a few of them carry but not all.
