A FFL can ship a firearm direct to a dept. if the LEO provides a letterhead. I have done it on numerous occasions.

I am trying to buy another gun for work and I would like to find the law that states it is OK to ship direct.

Does anyone have a copy or a link to the actual law??

I tried searching the ATF site but it sucks.

Either post it here or an IM will work.

That's a good question. During training (federal) someone asked a question about sending a gun for repair and the response was; "we can ship whatever we want, we're the law". That statement just shocked the shit out of me. If anyone could find an actual provision for this I would appreciate it also.

I believe a dept letterhead signed by an Administrator would be okay.  When I was shopping for my AR15, a few dealers would accept a letterhead and would ship directly to my department.   I also believe that this is a FFL standard which is enforced under the Violent Crime Control and Law Enforcement Act of 1994, thus it states "When any licensed manufacturer, importer, or dealer transfers a semiautomatic assault weapon to a law [[Page 17447]] enforcement  officer, the regulations require that the licensee obtain written statements, under penalty of perjury, from the purchasing officer and a supervisory officer, stating that the weapon is for use in official duties and is not being acquired for resale. The purpose of these statements is to prevent the introduction of semiautomatic assault weapons into commercial channels.

Repair is different......you can ship to any manufacturer or gunsmith. They can only ship the item back to where the item was shipped from.

The assault weapon part was for the expired AWB. That was separate than the other law.

I wish I didn't delete the e-mail I received from another FFL with the law quoted......oh well

will use the firearm in official duties
and that a records check reveals that
the purchasing officer has no convictions
for misdemeanor crimes of domestic
violence are not required to
complete Form 4473 or Form 5300.35.
The law enforcement officer purchasing
the firearm may purchase a
firearm from a licensee in another
State, regardless of where the officer
resides or where the agency is located.
