I'm not certain that it's still considered a crime if it is a person to person sale. Obviously if the employee had gone and filled out a 4473 and purchased it for the boss it would be a straw purchase, I'm just not certain if that applies to private sales. It sounds like this was a private sale.

For her to make a big deal out of an organization not wanting to lend a trademarked mascot / logo to an unknown cause is absurd.
