If you are having sex using a condom that the woman provided and it breaks and she gets pregnant are you still at fault?

[#1]
Yes.
1/23/2011 3:25:40 PM EDT
[#2]

1/23/2011 3:26:01 PM EDT

I always wondered if one could successfully use the "Poison Ivy" defense.  Saying she must have gotten out of the trash and inseminated herself.

[#13]

if a plane crashes after taking off from a treadmill is the treadmill responsible?
1/23/2011 3:32:05 PM EDT
[#14]
Yup, condom box even says not 100% effective against conception.

faulty condom + pregnancy = 18 years of child support....

YOU.
ARE.
ALWAYS.

FAULT.

You are responsible no matter what the circumstances.

I always provide my own condoms.  I know where they've been since they left the store.  I know they've been stored in good conditions (hot and cold temps can degrade the rubber).  I know damn well that there are no holes poked in them either.  I know things happen but at least I know my condoms have the best chance of keeping me out of trouble.

Also, it's never felt right to ask the girl for a condom.  The idea of it just seems wrong to me.

I've heard that given as serious advice before. better safe than sorry. I have a hard time thinking you could sell a jury on that fact.

What a strange question. Children are not a fault. They are not something that goes wrong. They are what is suppose to happen when you have sex.
1/23/2011 3:46:52 PM EDT
[#27]
1. If you cannot accept 50% of the blame for her getting pregnant, don't have sex.

2. Why in the fuck is she providing the condom?

Why does it have to be someone's fault?

Condom's break.  Since you are both busy making "the beast with two backs" I'd say either both, or neither of you are to blame.  It's for you to decide which, but you can't blame one and not the other (unless it was sabotage or the condom was beyond sell by date)

About 1 year ago a guy got hit with a paternity suit where a woman had oral sex ONLY with a man.  She later admitted that she recycled the semen via vaginal insertion and intentionally impregnated herself.  She also acknowledged that she did so without his knowledge or consent.

A court decided that he had full paternal obligations despite her sneaky, self-serving (some might say psychotic) actions.

Who else's fault would it be?

He chose to have sex, knowing that condoms aren't 100% effective.

He accepted that risk by following through.

It's not a question about condoms, it's a question about integrity.

If you stick your pecker in it, you are on the hook. If you are worried about the house brand condoms, bring your own or find a better class of hookers to share your blow with.

There's a very easy way to avoid this.  If you aren't ready to become a dad don't have sex.  You're not gonna die if you don't get your rocks off, and if you think you might you can always masturbate.  Yeah, yeah, self control isn't in vogue.
