Today, Cleveland mayor Frank Jackson announced his ideas to
combat gun violence. He wants to ignore state law that prohibits cities from
adopting laws that are more strict than those passed by the state legislature.
IIRC they tried this already and were smacked down by the Ohio Supreme Court.
This dummy wants to try again. Among his brilliant ideas:  




"... restricting gun owners
from leaving firearms in a place accessible to minors; and limiting gun
purchases to one firearm per person per 90 days." (excerpt from the Plain Dealer story)



Too bad Frank, those are prohibited by the Ohio
Revised Code:

Right to bear arms - challenge to law.










(A)
The
individual right to keep and bear arms, being a fundamental individual right
that predates the United States Constitution and Ohio Constitution, and being a
constitutionally protected right in every part of Ohio, the general assembly
finds the need to provide uniform laws throughout the state regulating the
ownership, possession, purchase, other acquisition, transport, storage,
carrying, sale, or other transfer of firearms, their components, and their
ammunition. Except as specifically provided by the United States Constitution,
Ohio Constitution, state law, or federal law, a person, without further
license, permission, restriction, delay, or process, may own, possess,
purchase, sell, transfer, transport, store, or keep any firearm, part of a
firearm, its components, and its ammunition.

What could a "1 gun per 90 days" city ordinance possibly accomplish? Anyone could just drive to a FFL in the next town and buy whatever they wanted anyway. A smart FFL would setup shop right over the city border

The state Supreme Court ruled on this in 2010 and told Cleveland to get fucked:

That's where all the shops are anyways, in the burbs.  I can't think of one gun shop this is in the actual city of Cleveland.

This kind of stuff needs to result in the Criminal prosecution of politicians.  They are violating the law by passing these laws and they need to be prosecuted.

No idea... the city of Cleveland has a 0% chance of going Republican, so it's not like he has to increase his appeal to likely voters. And he isn't a publicity hog like some mayors, he likes to stay out of the spotlight. I suspect he's just really dumb.

He might be getting $$$ from Bloomberg for trying, even if it fails.  Ohio is a good swing state to try to get the anti gun hooks into.  If it works, it's a stepping stone like it was in Jersey City.  If not, it was still a good test of the current climate.

I heard the "Safety Director" on the radio this morning. He claimed that local restrictions are a "grey area" and he wants the city council to start over with new local laws.



It's NOT a grey area dumbass,  the state law is perfectly clear that local restrictions are forbidden. You guys lost in the state supreme court,  remember?  I guess Cleveland has plenty of money to waste on another Quixotic endeavor
