Looks like a regular lower. So he would need the FFL to ship legally. The mag and the upper may be made to function as a blank gun, but that doesn't change the fact that the lower is the firearm.

Do not see a gas tube, might be one of those blank fireing plastic/cast airsoft types ? Markings don't make sense, Colt AR-15, then M16A1 ? Prop gun is my guess.
