A Clay County man died yesterday after being shot in the chest and another man was questioned and released in what police are calling a self-defense shooting at this time.

According to Kentucky State Police, Harold W. Smith, 56, of Manchester was shot in the chest at about 8:45 a.m. at the Bull Creek Trade Center off U.S. 23 south of Prestonsburg.

Police said their preliminary investigation revealed that Smith was involved in an argument with Douglas Moore, 65, of Martin. Police said witnesses told them that the argument escalated into a brief physical altercation after which Smith allegedly drew a small handgun from his pocket and threatened to kill Moore. Witnesses, police said told them that Moore then retrieved a small handgun from his pocket and shot Smith once in the chest.

Smith was transported to Highlands Regional Medical Center where he was pronounced dead by Floyd County Coroner Roger Nelson. Moore was taken to Floyd County Detention Center where he was questioned by KSP detectives and later released.

Police said preliminary details of the case were discusses with the Floyd County's Commonwealth Attorney who concurred with the detectives findings that this shooting appeared to be in self-defense. Police said the incident continues to be under investigation and once it is complete will be presented to the Floyd County Commonwealth's Attorney who will make a decision whether to present it to a grand jury. At this time no charges have been filed.

Detective Byron Hansford is leading the investigation and Detective Mitchell Adkins and Rick Conn are assisting.

Argument over Iraq war prompts fatal shooting

PRESTONSBURG, Ky. - A disagreement between two friends over the war in Iraq ended with the fatal shooting of one of the men.

Prosecutors and Kentucky State Police determined that Douglas Moore, 65, of Martin, acted in self-defense when he shot Harold W. Smith, 56, in the chest.

Both men had booths at a flea market when they began arguing over the war.

Police said the argument escalated into a fight, and Smith drew a small pistol from his pocket, threatening to kill Moore. Witnesses said Moore pulled a .38-caliber pistol from his pocket and shot Smith once in the chest.

It happened quite often during the Civil War. Neighbor fought neighbor. Friend fought friend. Brother fought brother.

This is fucking sad. Instead of fighting and killing the enemy, we are too busy fighting among each other.

Yeah, pretty damn sad isn't it?
That is what makes this war comparable to Nam, fighting each other.
I sure hope our country gets its shit together or our future is bleak.
