Firearm on Form 4 in FL and sold to person in Texas.
Is this the proper process? Owner (Form 4 person) contacts Dealer (Class III) in same state. The Dealer completes the paperwork from Owner to Dealer and there is a $200 transfer fee. When it returns, the paperwork and item is delivered to the Dealer in the same state. Dealer in same state then does paperwork to dealer in Texas. When paperwork returns then the item is shipped to Dealer in Texas by the Dealer in Florida. Dealer in Texas then fills out Form 4 for new owner in Texas along with another $200 transfer fee. Is this correct? |

Owner can do a Form 4 (with $200 tax) to buyer's in-state dealer. Buyer's in-state dealer then does form 4 (with $200 tax) to buyer. Does not save any tax money, but does save a transfer which saves time. |

If I follow, I just call up the Class III dealer in Texas and say I want to ship him an item and give him my info and $200 check then he sends it in and I ship the item when the Form 4 returns? |

Of course you must have the dealers info to do this. |

It does not matter who fills out and sends in the Form 4 as long as the transferor (seller) and transferee (buyer) are properly entered and the signature is original and correct. Both of the MG's I bought, my dealer filled out his portion of the form and then gave the forms to me. I then filled out my part and I mailed it in. In the OP's case iIt will require some coordination since the OP is in a different state then the dealer. ATF could also care less who sends in the check. It is supposed to be the seller, but it is almost always the buyer. |

Ok, so Form 4 from me to dealer. (I thought since a dealer it was a Form 3. But then if I knew I wouldn't have posted. I received the dealer info and will contact them to confirm. Afterward I will post back with what I did. Form 3 is a tax free transfer between 2 dealers. Since you are not a dealer, you have to use the tax paid Form 4. He will step you thru it. |
