Just got the email: Information to Pending NFA Forbearance Applicants Submitted Pursuant to Final Rule 2021R-08F On January 13, 2023, the Attorney General signed ATF Final Rule 2021R-08F, “Factoring Criteria for Firearms with Attached ‘Stabilizing Braces.’” Those possessing firearms with a stabilizing brace that were classified as short-barreled rifles under the Final Rule had until May 31, 2023, to file an ATF Form 1 application to register the firearm in the National Firearms Registry and Transfer Record (NFRTR), or to take other action. The NFA Division processed most of the ATF Form 1 applications it received but stopped when required to do so pursuant to Federal court orders. Ultimately, due to challenges under the Administrative Procedure Act, Final Rule 2021R-08F was set aside nationwide and has not been enforced. Even though it was set aside, individuals who filed an ATF Form 1 application pursuant to Final Rule 2021R-08F may desire that the NFA Division process their application and effect registration in the NFRTR. This may be the case for numerous reasons, including that firearms with stabilizing braces are regulated under State law and registration in the NFRTR provides an affirmative defense to unlawful possession of that firearm. Other individuals may have installed a regular shoulder stock, anticipating that their firearms would be registered. Consequently, ATF will begin processing the remaining applications beginning Wednesday November 12, 2025, unless those who submitted the ATF Form 1 applications provide notice to ATF that they do not want their applications processed. For those who want their firearms to be registered: No further action is required by you. ATF will process your pending application. For those who do not want their firearms to be registered: Those who filed the ATF From 1 application via eForms should log into the system and withdraw the application. Those who filed a paper application should notify ATF that they wish to withdraw that application by sending an email, including applicant name, firearm description and serial number, to mailto:[email protected] stating that the application is withdrawn. Any action to withdraw an application must be completed by Monday November 10, 2025. |

Yup got it too. The only question I have is will these approved applications be materially different from the $0 tax ones filed after Jan 1? If so, do I need to care about that in any way? I just remember people talking when the brace rule thing happened saying that these approved applications were going to somehow be inferior to "regular" ones and I cannot remember the specifics? |

No engraving requirement - that’s a plus in my eyes. I only had one application still outstanding and I sold that lower just recently so I withdrew the Form 1. |

Because that sure sounds swell. That was in the first posting of the ‘amnesty’ form 1 - you didn’t have to wait on approval, you could attach your stock after submitting… then apparently the revised revision of the revision changes said oh, wait, no don’t do that, but this revision of the revised revision of the continuance seems to go back to that. |

Has anybody talked about this? For SBR's that were factory built with pistol braces, the ATF logic is that you were in possession of a NFA item that made by someone else but not properly registered. They were just kind enough to create a rule to give you an opportunity to register it before charging you with a crime if you didn't. Since the factory already had their engraving on the firearm, there was no need for you to engrave it since you were not the maker. So, what about pistols that were braced by individuals after they left the factory? They just decided to apply the same rule, even though the same logic doesn't hold. |

Quoted: while that almost makes sense, it still means the engraving an SBR doesn't really matter all that much, because if it was really important and not just a punishment step, they would have required it on home made pistols they declared were SBRs after they declared they were pistols and then the courts declared them pistols again. I suspect the government figured the easiest way to get people on board was to waive the engraving requirement since most people can't do that step at home. All the other registration steps are (mostly) simple to complete at home by the average gun owner. To be clear, I'm not agreeing with the government's approach, merely trying to explain it. |

I've read that the majority of people got an email and I was wondering why I didn't get one since I had one submitted on 5/23/23 that was put on hold. I rarely check my spam email folders so maybe I did get one, not sure. |

It seems now the ATF decided to clear those backlogged forms and just finish them up since they were submitted anyway. So when these guys submitted their forms, they were under the belief that pistol braces were going to not be legal anymore. |

Because stocks are better than braces and free SBR’s without the need to engrave the firearm was just icing on the cake. The government already knows I have guns so big deal if I do more. |

I got my 7 form 1s back disapproved yesterday for a minor typographical error. I reached out to IPB and they told me because they rule has been vacated, I'm sol. Have to resubmit after Jan 1. No amending or correcting. They also mentioned that any draft F1's in the system on Jan 1 will be purged so don't bother pre filling them to save time on New Year's Day. |

My FIL’s old application was approved around 11/22 and he didn’t see where ATF sent him any emails prior to that. We had just logged into eForms and checked on the 21st and it was still pending at that time. It was weird since he sent his 1 form in about a month before the cutoff and I sent 4 on literally the last day, but mine were all approved quickly back then. |

It’s amazing that the tax money extracted from us is used to pay their wages to treat us like schit. Another big reason to purge the NFA.

I submitted 14 on May 30, 2023. I didn't get any back before the halt. I just left them in the queue hoping they would eventually approve them. Then I got the email saying they were going to process the backlogged forms. I got one every few days until today then evidently some examiner said "Fuck It" and approved the remaining 7 or so in about 45 minutes! |

Today my friend got a snail mail notice that his Form 1 application (during the amnesty period) was dissaproved because he missed a signature. NO instructions about what to do. I assume his options are: 1. Go into eforms and withdraw the application. (Or send an email to the ATF, as described in their email to him. Although the email said his email was supposed to be sent by Nov. 10th, and his disapproval was dated Nov. 18, and received by mail on Dec. 2) 2. Sign and re-submit the application (where? No indication where to send it.) 3. Ignore it. Any risks in doing that? |
