The swivel stud hole just got drilled a little of the 6 o'clock position. You can either drill a new hole in the correct spot...but a little in front of or behind the existing hole....or just get a swivel bipod and forget about it.

I think there is enough play in the bipod mount to loosen the mount nut, straighten the rifle, then tighten the bipod again. Have you tried that yet??

FWIW, DPMS ships rifles/uppers with free float tubes without the swivel stud installed. It comes loose in the factory packing with instructions on mounting. So in other words, the dude you bought it from installed the stud wrong and not DPMS.
