I have searched, w/o good results, information about using a preban stripped lowers in post 'Assault Weapons Ban' builds. The info that I have ran across has not cleared up my question but only confused me even more.
I have a preban Eagle Arms receiver that I would like to use to build a rifle. I purchase it before the AWB but never did anything with it after learning that using it to build a rifle during the ban would still have been illegal. Can I now legally use this lower to assemble a complete rifle by mating it an upper made/sold after the AWB expired? |
| I think there is an agreement that building up a pre-ban lower into a pre-ban rifle after the ban is in effect is an illegal act, but that it is impossible (or hard) to prove that it was done after the fact (if one were to say that it was built as a preban while still being preban-how could they prove otherwise?). If you use obviously newer components, then that would be a dead give away, but what if you used them to replace components that you put on your rifle prior to the law being passed? Are you sure you didn't build it as a pre-ban prior to the law taking effect, and now just want to swap some parts on the rifle? I'm not sure I understand your question. I would of course always encourage people to do the right thing. |

I have a preban lower that I bought before the AWB and never made into a complete rifle to the present date. My Question is, Can I now legally use this lower and mate it to a new upper (manufactured after the AWB expired) and complete the rifle? Is Jah141 correct that now the AWB has expired and the above senario would be legal? |
