Earlier this year the above wrote me asking for proof of my Colorado residency.   I sent them a photocopy of my driver's license that was issued in 2022 and the previous one that expired in 2022.

Unsatisified, they now sent me my calculated taxes based on my W-2; which does not exist since I didn't work for anyone.  They're hoping the amount due is small enough such that I won't make a stink.  I'm going to make a stink solely on the basis of the W-2 (they can always contact the IRS to confirm I didn't file one or work for anybody).

It’s been this way for a long time. They hounded me for years saying that I made $43k as an E3 in the military in the early/mid 90’s. After 3-4 years I finally got someone on the phone with enough intelligence to look at my SSN and the person they said owed. Had a letter within 2 days stating it wasn’t me.

You say first, a W-2 does not exist, then say your argument is based on your W-2.  Which is it?

How did they calculate "taxes based on my W-2", do you mean based on your 1040 (Income Tax Return)?

Did you file a 1040 for those years?

Even if self-employed ("I didn't work for anyone"), did you earn income in California?  



Remember, they wield the unbridled power of the government and can garnish your wages, seize your assets & accounts, impound your car, place liens on your real estate,... they can throw you in jail.  

CA has been bugging me about having not re-registered my truck, and as the coorespondance goes, they demanded that I send then proof of registration elsewhere, so, I sent them a copy of my AZ registration and DL as well as they demanded a copy of a current utility bill proving I was a resident of Arizona. They finally left me alone, SO FAR, But I am expecting the franchise tax board to hit me up again at tax time next year.

That’s some weird shit! I’ve never had to prove to any state prior that I didn’t live there anymore.

A footnote: I miss “home”, and I miss my family, Mom, adult children, my grandson, friends, etc. If CA weren’t so busy trying to implode, I’d have happily returned, I miss the scenery, especially the beach. :(

Last year my wife and I visited Wyoming, South Dakota and Arizona (Prescott).  The locals usually weren't excited about hearing we were from California, but quickly changed their tune when my MAGA lady recited all of what's wrong with the country and our home state, and I mentioned being an NRA and CRPA member.  We had several very insightful and fun conversations with like-minded folks.  Unfortunately, the Golden State, with all its commie failings, is not easy to walkaway from, as you mentioned.  Although we can sell our house and buy two homes elsewhere, Orange County offers just too many positives.  Therefore, my wife and I have decided to continue to fight the good fight in California, despite some family and friends being brainwashed Dems.  Luckily, there are many, many good and reasonable people trapped behind enemy lines with us to lend support.  Good luck with your situation.

The Franchise Tax Board here is notoriously inaccurate. Sony years back my mom passed and on settling her estate we sold her home. The state demanded that unpaid income taxes be paid and this caused all sorts of issues. Turned out there was another person with the same name but living in another part of the state and with a different social.

The state’s solution was to pay the taxes, sell the property and then get the money back later.

The realtor and escrow officer had seen this scam before and knew once the state had the money it would never be returned. A letter from an attorney working for the escrow company solved the issue.

A nice note that said; “Fuck off I don’t live in your PoS state any more and your fucking jurisdiction ended at your God forsaken border so Fuck off!” worked for me.

It’s not just the tax board that demands money not owed.

Some years back I received a notice that I had run a toll booth in San Francisco. They had a picture and a computer supposedly was able to read the plate. Explaining that my ‘78 2 door sedan looked nothing like the SUV in the photo and that I had never been through the toll booth fell on deaf ears.

By chance I came across a newspaper article about folks as far away as Michigan who had never been there getting harassed. The writer was able to make enough noise to clear things up.

I contact the writer, he took the details and within days things were straightened out.

I’ve since heard that it continues. I think they just pick some one at random hoping that rather than fight they’ll just pay to clear it up.
