With no gun makers left in the state, almost all modern guns owned by NY residents " originate elsewhere" The way that's worded it is going after lawful firearms commerce as much as it is any guns brought into the state illegally

Of course it is…..that is their end goal

They want everything tied up in courts

If they tread to hard on the Commerce Clause, and we eventually get a friendly federal administration, then I can see a friendly SCOTUS smacking them down both on 2A and Commerce Clause violations. Recall the state had a law on the books restricting interstate wine sales that was eventually found to violate the Commerce Clause by a ruling in another case.

The Commerce Clause is one of the few enumerated powers in the Constitution and the Federal government exploits it to the maximum in order to control just about every part of our lives. Why would they tolerate some state infringing on their turf if cuts into their powers? The 10th Amendment does not override the Commerce Clause since it is specifically stated as a Federal right.

As I read it, all this does is require the DCJS to publish their info on guns used in crimes.

So any time a gun is used in a crime, the serial is traced from the factory to where it was at the time of the crime and every step in between. This is standard practice. Has been for decades. This law does nothing to change that.

But what it does is mandate the DCJS publishes a report with all of their origin tracing info on guns used in crimes.

If someones reads this and gets something else out of it, please explain.
