Michigan bans open carry of guns at polling locations

Michigan announced a ban on Friday of the open carry of guns at polling places to avoid voter harassment and intimidation during the critical swing state election.  

The announcement by Secretary of State Jocelyn Benson drew a quick rebuke from some Republicans and gun rights activists, including the National Rifle Association, but the Democratic official said firearms at voting sites could cause fear and disruption for election workers and Michiganders trying to cast their ballots on Nov. 3.

“Fair, free and secure elections are the foundation of our democracy,” Benson said in a statement. “I am committed to ensuring all eligible Michigan citizens can freely exercise their fundamental right to vote without fear of threats, intimidation or harassment. Prohibiting the open-carry of firearms in areas where citizens cast their ballots is necessary to ensure every voter is protected."

Michigan leaders have been on high alert for armed intimidation, in the wake of gun-carrying protesters storming the Michigan Capitol and a foiled plot by Michigan militia extremists attempting to kidnap Gov. Gretchen Whitmer. President Trump, who has repeatedly warned of voter fraud, urged his supporters to be vigilant and "to go into the polls and watch very carefully because that's what has to happen."

Some sheriffs in Michigan have said they won't be enforcing a ban on openly carrying guns near polling places on Election Day.

Secretary of State Jocelyn Benson, Michigan's chief elections officer, issued the guidance to election clerks earlier in October.

It prohibits openly carrying a firearm within 100 feet of a polling place, clerk's office or absent voter counting board on November 3. Concealed guns are still permitted, unless the polling place is a location, such as a church or school, where firearms are banned.

But Benzie County Sheriff Ted Schendel called Benson's guidance "illegal."

"She doesn't have the authority to make laws," Schendel told the Traverse City Record-Eagle. He has been contacted for additional comment.

The newspaper reported that Schendel is among several law enforcement officers across Michigan who have said they won't enforce the ban.

Benson's guidance noted that the presence of guns at polling places on Election Day "may cause disruption, fear, or intimidation for voters, election workers, and others present."

Election workers were advised to contact law enforcement if anyone is seen violating the ban or intimidating, hindering or impeding voters outside the 100-feet limit.

Robert Stevenson, the head of the Michigan Association of Chiefs of Police, told Newsweek that officers won't be able to enforce the ban because it isn't based on law.

"The issue with the Secretary of State issuing the ban on open carry at the polling stations is she issued an administrative order. Michigan has an open carry law that prohibits open carry in defined locations. Polling locations are not one of those," he said.

"So the issue for us is not that we won't enforce the ban, it's that there is no law that we can enforce. We have no authority to enforce the secretary's order. This is exactly what prosecutors are advising us."

According to the Record-Eagle, the Michigan Sheriff's Association asked sheriffs to consult local prosecutors on whether to uphold the ban.

The ban has also been challenged in two lawsuits filed by gun rights activists and groups, according to the newspaper.

"Whatever the court decides we can do or cannot do to regrading open carry at the polls is what the Michigan chiefs will do. We will enforce any applicable laws," Stevenson added.

Benson announced the ban days after 13 men were charged over an alleged plot to kidnap Michigan Gov. Gretchen Whitmer.

Whitmer, a Democrat, later blasted President Donald Trump after he called for her to be jailed at a campaign rally in the state. "This is exactly the rhetoric that has put me, my family, and other government officials' lives in danger while we try to save the lives of our fellow Americans. It needs to stop," Whitmer tweeted.

At the first presidential debate in late September, Trump called on his supporters to "go to the polls and watch very carefully," sparking fears of voter intimidation or violence at the polls.

"I am committed to ensuring all eligible Michigan citizens can freely exercise their fundamental right to vote without fear of threats, intimidation or harassment," Benson said earlier this month. "Prohibiting the open-carry of firearms in areas where citizens cast their ballots is necessary to ensure every voter is protected."

Mum was getting her hair cut by "Kat", when a neighbor knocked on the door.

I was told to answer it. It was George Heartwell and I was wearing a MGO shirt and hat. He did a double take and just said he was getting his key to open up the river cabin.

So who's going to challenge this? She didn't specify the legal grounds for this order. I don't see anything in Michigan's voting laws regarding this or that would provide her authority to do this.

The liberal women we have running this state are nuts.  Just because they say something does not make it a law.  The Secretary of State has no authority to do this, it is nothing more than another liberal flapping their jaws.  Ignore it.

MICHIGAN COURT OF CLAIMS AFFIRMS THAT SECRETARY OF STATE BENSON LACKS LEGAL BASIS TO PROHIBIT FIREARMS AT POLLING PLACES
   
   
Michigan Gun Owners (MGO), a 501(c)(3) Michigan non-profit organization dedicated to protecting the rights of Michigan citizens, as enumerated in the Second Amendment and Article 1, Section 6 of the Michigan Constitution, along with Michigan Open Carry (MOC) and Michigan Coalition for Responsible Gun Owners (MCRGO) filed suit against Jocelyn Benson, Michigan Secretary of State for issuing an illegal and unconstitutional directive in an attempt to suppress the constitutionally protected rights of certain voters.  

On October 16, 2020, Jocelyn Benson issued a directive ordering all local election officials to post signage at the entrance of the building where the polling place is located, as well as at entry of the room of the polling place. This signage states that the open carrying of a firearm is prohibited in a polling place.

Today, Michigan Court of Claims Judge Christopher Murray affirmed our argument that Secretary Benson lacks legal basis to make up her own rules/laws where firearms at the polls are concerned. Judge Murry granted our request for immediate injunctive relief, meaning Benson's edict is invalid and is not enforceable.

Michigan Attorney General, Dana Nessel has already issued a statement indicating that the defendants intend to file an immediate appeal to today's ruling, thus further wasting tax payer's dollars on trying to circumvent the Legislative Branch of government in their ongoing attempt to allow the Executive Branch to create their own laws and rules.

We sincerely hope that there will be no incidents of actual voter intimidation at the polls, or worse yet, violence of any type. We do not condone the use of firearms for illegal purposes of any kind. However, we are very pleased with the Court of Claims ruling today, protecting the rights of LAW ABIDING citizens of Michigan. We will continue to fight the Executive Branch's push to circumvent the Legislative Branch and restrict/revoke the rights of law abiding citizens by appealing this decision.

I hate to say it, this is gonna backfire.
Some open carrier is gonna strap his AR to his chest and walk into a school to vote.  Perfectly legal. But poor optics.
