All the info I can find is a few years stale at this point so I decided to ask again.

Gun Trusts for NFA items.

I want to set up a trust that will have my father and myself. I want to be able to add trustees like a future spouse or children.

I have heard of people who have had trusts drawn up that allow them to add temporary trustees (if I recall simply by writing a letter for the individual and having it notarized) in order to allow friends/family to temporarily take possession of their NFA items. If this is kosher, I'd love to have the option.

Anyone have a preferred pre-made trust, or have a good lawyer who does these?

When I picked up my trust in Provo I was told that the notary part was no longer an option and that the background has to be completed.

So in order to add temporary trustees, they have to have prints and photos submitted to ATF?

It was my understanding that's what the 41f change the previous administration pushed through back in 2016 was.

Their response:

Settlors and trustees (not beneficiaries or successor trustees) are the only persons considered to be “Responsible Persons.” Intentionally, you are the only trustee (the only “Responsible Person”) on Day 1, so you are the only person who must submit fingerprints and photographs when you file your first ATF application to acquire your first NFA item.

Our gun trust forms allow you to appoint and remove additional co-trustees (authorized users) whenever you wish. However, you cannot appoint additional co-trustees while you have a pending ATF application. Any trustee can be in possession of any NFA item in the trust.

After you receive the tax stamp (and while there are no other ATF applications pending), you can appoint Additional Co-Trustees (authorized users) using the Appointment of Additional Co-Trustee form. The only time responsible person questionnaires, fingerprints, and photographs of all trustees (not beneficiaries or successor trustees) is when you are filing a new ATF application to acquire an NFA item.

Q: Will new responsible persons, added after the making or transfer, be subject to the same requirements?
A: Once an application has been approved, no documentation is required to be submitted to ATF when a new responsible person is added to a trust or legal entity. However, should a responsible person change after the application has been submitted, but before it is approved, the applicant or transferee must contact the NFA Branch for guidance.
