Emails sent, but, forgive me if I'm wrong... Reading the actual text of HF384 seems to read that it will also allow MGs, SBSs, and SBRs. Correct?

BY WINDSCHITL A BILL FOR 1 An Act concerning the authorized possession of certain 2 offensive weapons and making penalties applicable. 3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 1515YH (4) 85 rh/rj PAG LIN 1 1 Section 1. Section 724.1, subsections 1, 2, and 8, Code 1 2 2013, are amended to read as follows: 1 3 1. A machine gun. A machine gun is a firearm which shoots 1 4 or is designed to shoot more than one shot automatically, 1 5 without manual reloading, by a single function of the trigger. 1 6 2. A short=barreled rifle or short=barreled shotgun. A 1 7 short=barreled rifle or short=barreled shotgun is a rifle with 1 8 a barrel or barrels less than sixteen inches in length or a 1 9 shotgun with a barrel or barrels less than eighteen inches 1 10 in length, as measured from the face of the closed bolt or 1 11 standing breech to the muzzle, or any weapon made from a rifle 1 12 or shotgun with if such weapon as modified has an overall 1 13 length of less than twenty=six inches. 1 14 8. Any mechanical device specifically constructed and 1 15 designed so that when attached to a firearm it silences, 1 16 muffles, or suppresses the sound when fired. However, this 1 17 subsection does not apply to a mechanical device possessed and 1 18 used by a person solely for the purpose of shooting a deer 1 19 pursuant to an approved city special deer population control 1 20 plan if the person has a valid federal permit to possess and 1 21 use the mechanical device. 1 22 Sec. 2. Section 724.2, Code 2013, is amended by striking the 1 23 section and inserting in lieu thereof the following: 1 24 724.2 Authority to possess offensive weapons. 1 25 All of the following are authorized to possess offensive 1 26 weapons: 1 27 1. The following persons or entities when the duties or 1 28 lawful activities of the person or entity require or permit 1 29 such possession: 1 30 a. Any peace officer. 1 31 b. Any member of the armed forces of the United States or 1 32 of the national guard. 1 33 c. Any person in the service of the United States. 1 34 d. A correctional officer, serving in an institution under 1 35 the authority of the Iowa department of corrections. 2 1 e. Any person who, under the laws of this state and the 2 2 United States, is lawfully engaged in the business of supplying 2 3 those authorized to possess such devices. 2 4 f. Any person, firm, or corporation who under the laws of 2 5 this state and the United States is lawfully engaged in the 2 6 improvement, invention, or manufacture of firearms. 2 7 g. Any museum or similar place which possesses, solely as 2 8 relics, offensive weapons which are rendered permanently unfit 2 9 for use. 2 10 2. The following persons who possess an offensive weapon 2 11 which is a curio or relic firearm under the federal Gun Control 2 12 Act of 1968, 18 U.S.C. ch. 44 and the federal National Firearms 2 13 Act of 1934, 26 U.S.C. ch. 53: 2 14 a. A resident of this state, if the offensive weapon 2 15 has been permanently rendered unfit for the firing of live 2 16 ammunition. The offensive weapon may, however, be adapted for 2 17 the firing of blank ammunition. 2 18 b. A nonresident, if the offensive weapon is legally 2 19 possessed by the person in the person's state of residence 2 20 and the offensive weapon is at all times while in this state 2 21 rendered incapable of firing live ammunition. A nonresident 2 22 who possesses an offensive weapon under this paragraph while 2 23 in this state shall not have in the person's possession live 2 24 ammunition. The offensive weapon may, however, be adapted for 2 25 the firing of blank ammunition. 2 26 3. A person who possesses a device described in section 2 27 724.1, subsection 8, or a machine gun, short=barreled rifle, or 2 28 short=barreled shotgun, as those terms are defined in section 2 29 724.1, in compliance with the federal Gun Control Act of 1968, 2 30 18 U.S.C. ch. 44 and the federal National Firearms Act of 1934, 2 31 26 U.S.C. ch. 53. 2 32 Sec. 3. Section 724.3, Code 2013, is amended to read as 2 33 follows: 2 34 724.3 Unauthorized possession of offensive weapons. 2 35 Any person or entity, other than a person or entity 3 1 authorized herein in section 724.2, who knowingly possesses an 3 2 offensive weapon commits a class "D" felony. 3 3 EXPLANATION 3 4 This bill relates to the authorized possession of offensive 3 5 weapons. 3 6 The bill modifies the definition of a machine gun, a 3 7 short=barreled rifle, a short=barreled shotgun, and a 3 8 mechanical device that silences, muffles, or suppresses the 3 9 sound of a firearm when fired, defined as offensive weapons 3 10 under Code section 724.1. That was the way I read it. It eliminated the ban on these items and deferred back to NFA and the BATF for regulation. If not authorized by BATF, it would remain a class d felony.

Supposedly there is an amendment to the bill coming, a lot of people have talked about it but I haven't seen any evidence of it.

I got a personally typed, not form letter response from my rep. Voting for it is a small win, having more Rep. Windschitl's that go out and put some effort into it is more of what we need.

Got this response this afternoon from Rep. Marti Anderson - Dist. 36 (Dem from DSM area)
Thank you for writing to me. I will listen to the arguments for and against this bill before finally making up my mind on whether or not to support it. I do understand why hunters and sport shooters would like to use suppressors. The bill sponsors must assure me, however, that this bill won't result in more human bloodshed.
I took an oath to support the Iowa and US Constitutions, including the second amendment. I have no interest in taking guns from law enforcement or from law abiding people who take responsibility for care and use of their guns. Hunters, collectors, and sportsmen understand the law and know proper care and use of their firearms. Having said that, I worked as a crime victim advocate for 34 years. I have witnessed the pain and grief of misused firearms in shooting injuries, death related to crime, accidents, and suicide. I have come to believe that while we protect our Constitutional second amendment, we can still use our common sense to reduce gun injury and death. Thank you again for writing to me. Thank you for taking the time to read, and respond to my email. Your response is genuinely appreciated. I'm glad to hear you will be giving this bill honest consideration. The fact is, in the 39 other states that allow suppressors, crimes involving these accessories are extremely rare. Incidents involving suppressors are so few in number that it's difficult to even determine a crime rate involving these items. This is almost certainly because those owning suppressors recognize the hoops they must jump through in order to purchase and possess them. In the 39 other states that allow suppressors, responsible, law abiding gun owners who want to buy a suppressor must do much more than simply pass a NICS background check at their local sporting goods store. Buying a suppressor requires a full FBI background check - of the sort undergone by people applying for a federal job. This process currently is taking more than nine months to complete. There's also a $200 tax that must be paid by the individual in order to cover this background check. Assuming a gun owner passes this additional background check, they must keep a copy of this tax stamp/background check with them at all times while using their suppressor. Illegally possessing a suppressor brings a mandatory federal jail sentence of up to 10 years and fines of up to $250,000. Owning a suppressor is not the same as just owning a firearm. The purchasing process is more arduous, more expensive, and takes longer - and the penalties for misuse are also much steeper. Logic, and the facts listed above, would tell you that one does not simply purchase one of these items on a whim. The start to finish process of purchasing a suppressor goes so far above and beyond the process of buying a firearm that their owners work extremely hard to maintain their upright legal status. There will almost surely be emotional pleas and arguments about legalizing suppressors. But at the end of the day I challenge you to set emotion aside and let logic determine your vote. Thank you for sharing your thoughts regarding HF 384. I will be supporting the legislation. ...short and to the point no b.s. just like every response I get from him regarding gun rights. His biography for those that don't know... Guy Vander Linden was born and raised in Oskaloosa, Iowa. He is a 1970 graduate of the University of Iowa and holds a Masters Degree from the University of Southern California. After graduating from the U of I, he joined the United States Marine Corps, serving initially as an artillery officer. He transitioned to aviation in 1973 and served the next 27 years as a helicopter pilot. His flying duties included a tour as a Presidential Helicopter Command Pilot, flying Marine One for President Ronald Reagan. He also commanded a helicopter squadron in the first Gulf War and the Naval Aviation Depot, Cherry Point. He is a graduate of the Marine Corps’ Amphibious Warfare School, Command and Staff College, and the National War College. Retiring from the Marine Corps with the rank of Brigadier General, Guy served as a private sector consultant to military aircraft manufacturers. He is now enjoying retirement by serving as a volunteer for organizations in Oskaloosa like Habitat for Humanity, the Y’s Men’s Club, and Trees Forever. Need update (good or bad) before I need to get blood pressure medication... it is hard to update, since things move so quickly... one day the legislation resides here, then in two hours it changes to that, then it gets this part removed, then 45 mins later this gets added, etc. SHORT VERSION? we have traction in the house and senate in bipartisan manner, and as long as you guys keep doing the heavy lifting with emails, calls, and discussions with our elected officials, we can make this happen. it is IMPERATIVE you do these things and encourage others to as well. if you're setting around sending emails and your wife is staring at your over a cup of coffee, why the hell don't you hand her the laptop and let her send an email in via the IFC Action Center too? you just doubled the amount of correspondence they get when we think like this... volumes of communication speak directly to our need. |

Just saying. lol... very kind, but this is the culmination of TONS of work by more people than i can list. i'm tickled to be part of it. if we didn't have people working gun shows, working events, building rallies, working the rallies, posting here on the net and spreading the word, contacting their reps and sens, people working at the capitol, and most of all, you guys sending letters, calling, etc., this could never work. our IFC folks are working perfectly with NRA on this, and it really shows. our new NRA liaison is absolutely stellar! if we back up what our people are doing at the capitol with fire missions we'll get movement on our issues. |

I WANT MY CAN I believe Iowa legislature is only in session until mid/late April, so if its going to pass it'll have to pass before then. As for when laws take effect, I dont know how that works in Iowa but it'll most likely be Jan 1 2015 |
