Not correct.  Article II, Section 8 gives Congress the power to establish a system of patents but does not require it to do so:

Wake boats would not exist without them.  Highly litigated area of intellectual property bc the companies that spend big $$$ on engineers to make the largest wakes have their designs stolen almost instantly.  Stolen bc the designs are patented and they can protect their property right through the courts.

Yes. I do think it should NOT go woke, as it is currently trying to do.

I think getting a patent should be harder when something like 2/3 get invalidated when challenged.

Fun fact: the average cost for patent infringement litigation for just the attorney’s fees is about $2.6MM if the amount in dispute is $10MM or less (per side!)

Of course there are ways to offset that cost with insurance policies (both for if you are sued or have to sue), litigation funding, a willingness to license, etc.

I voted no in its present form.

It's way too difficult and confusing for a layperson to get a patent or trademark.  If the process was streamlined so that all you had to do was submit your idea and then they issue the patent if it hasn't already been done before, that would be great.

Also "protective patents" where companies patent things and then don't produce them need to go away.  If you patent something you should have to make and sell it, or get out of the way and let other companies make and sell it.

USPTO has a pretty straightforward guide to pro se applicants. even huge discounts for related fees. I have seen lots of people get patents and trademarks on their own.

Intellectual property in the US is worth $6T. I think we have the wrong approach, we should tax it.

A 10% tax on IP would raise $600B a year. That's nearly double what the corporate tax brings in. So we could eliminate the corporate income tax and replace it with a tax on IP, and all of a sudden making things would be basically tax free.

You can do the valuation with a Harberger tax. Basically the companies assess their own IP and if someone thinks they went low they can pay like 120% of what the IP is worth and buy it.

All of a sudden your patent trolls are playing a losing game. If their IP is worth anything they'll end up selling it, and they can't afford to hold on to IP that they aren't using.

Best part? The tech industry is 90% IP. They'll be heavily taxed and other businesses won't be taxed at all.
