Looks like most burglaries are felonies in MN. For them to be 1st degree, the person needs to "commits a crime while in the building". Other degrees mention felonies and stealing, but 1st degree is 20y in prison, potentially.

I am way too lazy too look up MN law, but a lot of places a “first degree” burglary requires an extenuating element, like being armed during the crime.
That would be richly ironic if true in this case. |

Snatch and grabs after a funeral are probably a fairly common thing. Sometimes it is to take something that you have asked for and failed. Sometimes it is to take something without having to deal with a confrontation.
I can easily see this situation: She is not on speaking terms with her stepmom. She still has property in her father's house. She tries to retrieve her property and her stepmom files burglary charges - even though she has legal access to the house (she inherited part of it), and the property taken was legally hers. Karen's can be Karen's. |

Unstable middle aged woman goes off the deep end.
Broke into her stepmother's house through a basement window while stepmom was home. To steal her father's ashes and other stuff because stepmom was not talking to her after an argument. Items included pictures, laptop, flannel shirt, and fathers ashes. Was dressed like a movie cat burglar including putting a sock over her flashlight. Stealing her father's ashes was bound to be noticed and the suspect list would be short. Not a great plan

609.582 BURGLARY. Subdivision 1. Burglary in the first degree. Whoever enters a building without consent and with intent to commit a crime, or enters a building without consent and commits a crime while in the building, either directly or as an accomplice, commits burglary in the first degree and may be sentenced to imprisonment for not more than 20 years or to payment of a fine of not more than $35,000, or both, if: (a) the building is a dwelling and another person, not an accomplice, is present in it when the burglar enters or at any time while the burglar is in the building; (b) the burglar possesses, when entering or at any time while in the building, any of the following: a dangerous weapon, any article used or fashioned in a manner to lead the victim to reasonably believe it to be a dangerous weapon, or an explosive; or (c) the burglar assaults a person within the building or on the building's appurtenant property. |
