Update: Lawsuit filed in May of 2024. Filed in NC Superior Court. City of Greensboro gets it moved to Federal Court. North Carolina Captain Terminated for Social Media Post Claims Free Speech Violation |

I followed the wormhole into the filing and the case and case law looks pretty good. In essence, according to the GFD's disciplinary policy, they place his personal, 1st amendment protected speech, that neither impacted his job performance nor criticized his department, on par with felony criminal convictions as evidenced by the degree of punishment, though, the policy itself categorized it as a class A offense, requiring reprimand, then escalating suspensions. None of those things happened. That's aside from this being protected conduct. There's a litany of case law that backs up his case. In reality, Greensboro doesn't even have a bad written policy. It's their unwritten policy, or rather, their pattern of conduct that is going to be their undoing. They simply can't retaliate for protected speech that happens outside of official duties. Hell, case law even supports criticism of your own department when done in your personal capacity. |

We aren't allowed to post anything political (civil service). There are always people that try to toe the line. It just aint worth it. When it comes to memes that might be seen as offensive. That ain't worth it either. As even if you aren't terminated you might end up with some kind of 'discipline'. That ain't discipline. IE getting moved straight nights to a shitty shift. I have social media but I never make posts around the job. And don't make any political. Religious. Or hot button posts. No meme posting or forwarding. I enjoy posting on forums due to the anonymous nature. I can say what I think without my name being attached thus my 'agency' not being represented by me or my opinions. When it comes to facebook/instagram. I keep that shit low key. I also know a few people that have gotten in trouble over snapchat stories. Which means someone in their friend-group took a second phone and photoed/videos what they put and ratted them out. Something that was technically private and should have only been distributed amongst their 'friends'. Obviously they can't discipline that too hard but people have gotten represented in milder ways for it. IE getting moved to a different shift or drafted for a shit detail or something like that. |

Long time needed update. They've conducted depositions and gone through discovery. One of those deposed was the former City Manager, who upheld the firing of my friend, but then later the City Council sent that former City Manager packing because he was banging one of his assistants. So the now former City Manager has no loyalty to the City and probably has a bone to pick himself. Everything is "confidential" up to this point. Anyway, looks like they're going to trial. I made a public records request for all the invoices from the law firm representing the City of Greensboro, but it's been 9 weeks and they haven't fulfilled it. |

| Update, They're still filing motions and objections and stuff, trial isn't set yet. So far, the City of Greensboro has spent $213,699.70 on legal expenses to a an outside law firm. And they haven't gone to trial yet. |
