So I might be opening a can of worms here but I left my truck unlocked and had my glock in my center console. It was in an Allessi hand made holster (sure I’ll never get that back and he has since passed so they don’t make them the same if at all).  I reported the pistol stolen 3/11/2020.  On 5/31/20 I got a call from a neighboring city’s PD.  The nice young gal says “we have your gun, come pick it up”. I had never been more relieved about anything in my entire life!  Well, unfortunately the person who had my pistol was a long time DOC inmate.  (The detective handling my case have me the individuals name who was in possession of my glock, the case is not done yet and hasn’t even started so I do not want to post his info).

Broken down story-He went to prison 20 years ago for stealing a few bucks and a hat or something very minor.  I think this led to 20 something years of continuous violations that extended his sentences. A lot of sob stories written about him and how prisoners are treated unfairly.  These nasty SOB cut one of his testicles off and hung it from the exterior of his cell door. He also threw bodily excrement on DOC Officers. Basically this guys is a giant piece of shit and you can probably figure out who he is with the information provided.

I am in contact with the local detective handling the case but the suspects actual trial is going federal. The lovely covid has everything backed up so I keep getting told I will get my pistol back but not sure when. He has also kept firing his defense attorneys also prolonging the case.

Sorry for the somewhat long post/rant........WHAT ELSE CAN I DONTO GET MY GUN BACK?!?!

I have tried playing the pity party of “it’s dangerous times right now and I need to protect my family!”

I don’t know what else to do, besides wait impatiently.

Until the case is concluded and all appeals run out, you will not be getting your gun back.  In a federal case this could be as long as 36 months, with COVID it could be even longer.  I would contact a friendly attorney and have her contact the case agent to make them aware that you are the registered owner of the pistol and would desire it returned by the court at the conclusion of the case.  You will need a Judges' order for this to happen.   Sorry to be the bearer of bad news.

Long story short, I purchased a CZ-75 from a Police Sgt.  He had stolen several firearms from an evidence room, 3 years later, I got my CZ-75 back.
When will I get my stolen pistol back.

Thanks for the response.  Is 36 months a cap on the length they can hold it?  Or is that just a heart lightening estimation. Lol.

Estimate, it could be much, much longer. I would write off your stolen pistol and get a new one.  If all goes well, someday, you or your heirs may get your stolen Glock back.

If the prosecution is in fact by the US Attorney in Federal Court... they have the speedy trial act.

It is hard for the defense council to drag out the trial like it is in state courts.

That is good and bad.  If after the speedy trial the defense atty files an appeal and it has merit... that could drag it out.

All evidence will be held until after the appeal, and the case it totally resolved.

It sounds like the Federal case could be felon in possession of a firearm... having an appeal with merit is unlikely.

State court trials can and often are a duration measured in years.

My step-daughter was murdered by her "boyfriend" at a "fun weekend" at an upscale Casino this past August.

We have been told at the earliest the trial is 2 years away... and it is a slam dunk case.

It is also easier for an appeal to be processed in state courts.

I have since moved 20 miles outside of my metro area. I have a 1/4 mile private lane to my hairs shared with 1 person. No one will be entering my property unwanted and leaving this time.....

I know it won't help but consider it a relatively cheap lesson.
The guy could have committed a murder with it and you would be sued for negligence.
Also, never leave a firearm in an unattended vehicle, even a locked vehicle is a smash and grab from a robbery.

This.
And they are not going to make sure it gets oiled after handling.

Even Glock barrels can rust in the bore.

Plan to wait a while.  We have an FFL and a local PD flips us evidence guns on a disposal contract once they are no longer needed for the court cases.  Our latest batch has intake dates of 2018.

Some of the more left leaning counties in Virginia will try and make it so expensive folks just give up.

It does not take all than many hours of legal time to get past the value of anything that is not REALLY expensive.
