Depends where it happened.



If out in the "middle of no-where"  I might be able to agree with "no victim, no crime", however doing it in a populated area is reckless endangerment.

Your question is so, uhm questionable, I will go with yes you should be prosecuted for something. I am not even sure what, but something.
