It's also a law that is VERY far away from 1791 and makes the least amount of sense. This, but also go after the Bronsozian angle. If something is a tax, it must generate revenue. Does Congress’s power to tax give it the power to punish the possession of unregistered machineguns under § 5861(d) of the NFA, even though it is impossible to register and pay tax on those machineguns, the law generates no revenue, and the only enforcement mechanism is prosecution? |

If the NFA was repealed, it’d only cost you $1K for the gun and whatever a smith charges to remove the sear block/shelf and either weld your carrier for the sear trip or just swap for a new carrier. Then hook up a full auto trigger pack and you’re good. Now if you want it to be German and say HK on it, figure 2.5-2.8K for a SP5, then send it… smiths can even re-mark it to say MP5. |

That Wyoming guy got shot out of the water pretty darn quick due to lack of standing (sued as individual, and not for his trust), but also because the District Court Judge can't believe peasants should have the same things the King does: Wyoming Chief U.S. District Court Judge Scott Skavdahl said he couldn’t permit DeWilde’s argument because it’s contrary to U.S. Supreme Court rulings. “Plaintiff’s argument logically would demand that the entire law-abiding citizenry is permitted to possess the same weapons our armed forces utilize,” wrote Skavdahl in a Monday order dismissing DeWilde’s lawsuit from the federal court. “Where is the limit? Tanks, bombs, nuclear weapons? “This is beyond outlandish, yet it is the logical result of Plaintiff’s argument that provides no limit. The Court declines to permit such an astonishing result.” Same judge that struck down Wyoming's gay marriage ban one day after hearing arguments, Obama-appointed, etc. has identified "the limit" mere citizens should have, apparently.
