IV. Procedure

Deputies should not stop citizens or try to acquire information on their firearms if they are not directly related to a criminal investigation or suspected of a possible crime. Information for the firearm log can be obtained from any persons during a valid investigative stop whether the gun is ultimately seized or not or whether or not the person is ultimately charged with a crime.

That's generous of them, since to do so would be unconstitutional anyways....

Just briefly looking at it, the fact that it instructs deputies to search and seize firearms in "plain view" at any call, is going to implicate the 4th Amendment in any case where the possession of a firearm, such as inside one's home, doesn't amount to probable cause for a search/seizure. If it's no longer in the person's arm reach, Terry v. Ohio can't be used to temporarily seize teh firearm for "officer safety." They would need a search warrant for a firearm in a home, and would need probable cause for a firearm in a vehicle, backpack, etc.

This would most likely allow for the rare successful "Monnell Claim" for a pattern/practice/policy violation against this particular county.

Sheriff Roundtree is as corrupt as the 2020 presidential election and he has been for as long as I’ve lived in the area.  The demographics and corrupt county will never remove him, ever.  He’s tried a number of blatantly illegal initiatives and was hand-slapped several times.

"that is the subject of a criminal investigation"

I'm not an expert in this field, but I assume if I ever come into contact with a LEO when I am being investigated for a crime while carrying a gun, that the S/N is going to end up recorded.

I'm not a holster sniffing badge bunny and I'm not worried about this.

You should be.  The “firearms log” is a simple Excel spreadsheet that is not secured and used by a very well known, corrupt sheriff’s office in a very corrupt county.  I’ve seen such spreadsheets leaked out and while I would worry about the sheriff’s office and DA in Richmond Country, I would be more worried about your information being sold to someone who would like some new firearms.  I was at Fort Hood after the MAJ Hasan shooting, the Corps Commander asked a question about how many firearms are registered on post…the next day the Garrison Commander sent all the commanders an Excel spreadsheet listing names, addresses, entire inventories and serial numbers.  It’s not a secure method for a “firearms log” in the least.  I would be very worried.  It’s not about what you own, it’s WHO knows what you own and where you live…

“Deputies should not stop citizens or try to acquire information on their firearms if they are not directly related to a criminal investigation or suspected of a possible crime”

But…

“Information for the firearm log can be obtained from any persons during a valid investigative stop whether the gun is ultimately seized or not or whether or not the person was ultimately charged with a crime”

Define a “valid investigative stop”.  That could be expired tags, no turn signal, break light is out…that’s my concern.  I think it would be wise if stopped when CCWing in Augusta (Richmond County) and asked if you have a weapon that you follow the requirement to answer and say yes.  Anything beyond that would require a warrant or to be charged with criminal conduct…have your lawyer’s contact info handy.

I honestly don’t see this going too far.  Richmond county may be corrupt and heavily democrat with all kinds of socialist schemes, but they’re stupid as shit, incompetent, and they never do their homework before they launch initiatives like this.

@ROCK6 you should reach out to the GOA - whomever the GA representative is. I wouldn't doubt if they're not already on it. But someone experienced needs to file suit here. Just not Lin Wood, lol.

ROCK6 .   Add to your list of " valid investigative stops " Purchasing a used truck in richmond county  and attempting to drive it back to another county .   Seller removes the tag and the buyer is then stopped for no tag even when bill of sale is in hand .   The above is an incidence that happened on Bobby Jones .   Buyer was hand cuffed and taken to jail .  Buyer had no record and was not wanted for anything .  Buyer also had proof of insurance .

County was sued and they had to pay but drug it out for a very long time .

gd

The last one out of richmond county with any honesty,  please remember to turn out the light .

Any weapon they come into contact with will be the subject of an NCIC query. Anyone who believes that can't be used as a defacto firearm database is naive.

There is already a GA state court decision that says LE in GA can't seize or run serial numbers on firearms as matter of routine.

Came out of a case of a cop stopping some guy. Guy was going hunting or something, LEO sees gun cases in the backseat of the truck. LEO then seizes and runs the serial numbers of each firearm.

The court said, LE can't do that. LE can only seize the guns if he reasonably believes the firearms are stolen or used in the commission of a crime.

Sheriff is going to get sued.

Good.  Where do I send money to help with the lawsuit?

It won't help in that county. Augusta has been turned into a democrat ghetto. I avoid it like the plague. Had a very conservative buddy that moved there as a firefighter and then emt...he is so liberal now that I can't stand to talk to him. Took less than 5 years for him to convert.
