Quoted: Or if I want to rob you safely, I can just report you and then invade your home at my leisure. View Quote View All Quotes View All Quotes Quoted: Quoted: Police in California can seize guns without prior notice starting Jan. 1 Family members who believe a loved one poses a danger to themselves or others will be able to ask police to seek a temporary "gun violence” restraining order from a judge beginning Jan. 1. The order would allow police to seize the person’s guns for 21 days. *** Under the new law, a restraining order could be issued without prior knowledge of the person. In other words, a judge could issue the order without ever hearing from the person in question, if there are reasonable grounds to believe the person is a threat based on accounts from the family and police. *** After three weeks, the person can challenge the judge’s decision. So on the word of a family member you can't get your guns taken away then in three weeks have to go to court to prove your innocence to get them back, I could have sworn in the US a person is presumed innocent until proven guilty according to the law. Seems to me the issuing judge is the one that needs to go to court and prove the person stripped of their rights was guilty not the other way around. Or if I want to rob you safely, I can just report you and then invade your home at my leisure. |

Yeah right, 21 days and then they simply don't give them back and you have to spend $87,000 on lawsuits and they just ignore the judgement anyway. Years later, some asshole drops off a rusted pile of crap with case numbers etched into the receivers, missing optics, no ammo and all pre-ban items melted down.

Quoted: Quoted: We would live in a great country if all the police enforced the provisions in the BORs as strenuously as they do drug and gun laws. What's your theory on why they don't? Incentive. People will always do what they're incentivized to do. If you want a salesman to sell more of something, you increase his commission on that item. If you want a police officer to enforce more of something, you put quotas on it and/or push it as a department agenda. If police departments nationwide said tomorrow "we need to write more tickets for jaywalking", you'd see a massive spike in tickets for jaywalking. It's that simple. |

Not only do accusers not have to prove (just assert) anything but loser has to convince judge of innocence,,,afterwards. Can't get more "american" than that. That's the new "equal protection". Obviously evil for even wanting your guns returned. |

My sister asked me to be the executor of her state about a month before she died from cancer.
She had specific provisions in her will on how the money was to be doled out to her surviving children (one adult, two minors). Her first husband didn't like that and was trying to fuck his own son out of his inheritance. Fast forward about 8 months after her death the X tries to strangle me in the middle of a Sears store on a Saturday. The following Monday him and his new wife are at the courthouse trying to get an OP/restraining order put out against me. I quickly got a lawyer, and put on a nice suit and went to the court room. The judge saw through their bullshit, and denied it. Then the new wife had a meltdown in the courtroom and made up all this bullshit about me and saying "BUT...BUT...BUT..HE HAS ALL THESE GUNS!" My lawyer grabbed me by the elbow and was like "let's get out of here." So, yeah, this new law is going to be used vindictively by spiteful family members or X family members. |
