[ARCHIVED THREAD] - Pistol brace rule signed (VACATED 6/13/24) (Page 17 of 160)

Quoted: So what was the thing about if you want to get their free stamp with a trust? They want some sort of proof the trust owned the firearms in question before such and such a date? Do we know yet what sort of proof they'll want? They don't say. And the FAQ says "before publication" and EForms says "before 1/13/2023" so clearly they don't know what the fuck they're doing. |

Quoted: So what was the thing about if you want to get their free stamp with a trust? They want some sort of proof the trust owned the firearms in question before such and such a date? Do we know yet what sort of proof they'll want? My guess would be a notarized schedule A showing the make, model, and serial # |
|
Quoted: Curiosity. 4 schools of thoughts posted here: 1) Free SBR stamp no strings. 2) Admit that you committed a felony and get "free" SBR stamp. 3) FATF. 4) Hold as you are, until it all shakes out. Am I missing something? Edit: Should I neckbeard braces while the market is cold? ![]() I just listed one super cheap in the EE |

Do we know yet what sort of proof they'll want? Notarized Schedule A I think. I’m also figuring on them checking with the manufacturer going forward for the date of creation of all serialized lowers to eliminate any ones made after the publication from being used. Can’t be on your list prior to day 1 if it was made on day 87. |
|
Quoted: No because you would still have the makings of a SBR regardless if it’s together or not. Plus, you would have to reassemble it at some point to use it and you wouldn’t have your permission slip if for some reason they checked for it. Please correct me if I’m wrong. It's only an SBR when fully assembled. When the upper is off the lower it is not in an NFA configuration. |

Atf list of Commercially available firearms equipped with a “stabilizing brace” that are short-barreled rifles* *May not be marketed by original manufacturer in displayed configuration, rather a wholesaler or retailer This is not an exhaustive list of commercially available firearms equipped with a “stabilizing brace” that are short-barreled rifles. However, this list is representative of how ATF will apply the definition of “rifle” to firearms that are equipped with a “stabilizing brace.” For purposes of this document, the term “short-barreled rifle” is used to refer to rifles with a barrel or barrels of less than sixteen inches, that are subject to the provisions of the NFA. https://www.atf.gov/rules-and-regulations/docs/undefined/bracefinalruleguidance-commerciallypdf/download |

The ATF really wants their gun registry. Bad. Didn't this very type of fiat decree by a three-letter agency get addressed by the SCOTUS in the EPA ruling? Were they not told they didn't have the authority to do this kind of bullshit? I guess this is the ATF's way of sticking their middle finger in Justice Thomas' eye. |
|
Quoted: A brace doesn't make it a pistol. Lack of a stock with a barrel shorter than 16" does. If you put a brace on that pistol, you made a illegal SBR and are admitting it to the ATF. Now according to the ATF. just registering any pistol and not claiming it was braced is just regular form 1'ing a pistol. Until this ruling, a brace was not considered a stock, and it was determined to be not designed to be fired from the shoulder, with only a pistol grip it was a pistol. This ruling redefines a brace as a stock. |
|
Quoted: By their definition, it’s not considered registered until you get the stamp correct? If that’s right, would that bar you from changing the brace to a stock in the interim? Its kinda buried in there but they basically say "As long as you have a receipt or proof that you submitted/filed it you are totally ok trust us bro wink wink" |

Text, history, tradition. I believe this gentleman might have thoughts on the matter at hand. Attached File |

Quoted: How do they know if it previously had a brace? There is nowhere on the (new rule specific) eForm 1 application that asks for a picture of the brace or some other form of proof. @S1W From what I've gathered, they don't and probably can't discern that. However, despite it lacking on the new eForm 1, I believe the new ruling says they can ask for a picture of it, but I forget where it said that. The question is, will they even care to ask? My money is on no. |

Quoted: It also looks as if I am going to buy a few braces this weekend, slap them on some lowers, and amnesty register them as SBR's so I can swap out the braces for real stocks once the stamp is approved. Once it's an SBR, you can freely swap around parts and it's still a registered SBR. What a patriot. |

Quoted: This is why I'm waiting this shit out. Government overstepped their bounds. They are an agency completely out of control. It's unnerving to watch leftist states and agencies not only ignore the SCOTUS, but deliberately, openly, mockingly defy it by announcing even more wildly unconstitutional laws and regulations. If these lawless, tyrannical states and agencies no longer recognize the SCOTUS as having any authority over them, what's to stop them from announcing they no longer consider the Constitution to be the law of the land? "Oh, the Second Amendment? We don't like it, so we no longer recognize it. Turn 'em in, America. Turn 'em all in." |

Quoted: Has Nolo or any of the legal oracles had a chance to opine on this yet? I'm waiting for Mr. Guns n Gear to weigh in on it. My guess is that he's shooting the video as I write this. He always has very good insight and observations about this kind of stuff and I know this time will be no exception. |

Nothing against him specifically but there’s gonna be epic levels of clickbait bs flowing. |

He doesn't have it posted yet on his YT page. Thanks for the link! Off to watch now. |

So you can get a free stamp for your brace. So if braces are stocks, can I get a free stamp for a stock? Since they’re the same now and both lead to an SBR. I’m sure I already know the answer, and I know it’s as arbitrary and made up on a whim as the authority they have to do this in the first place. |

But other than that, swamping the registry with “free” SBRs is going to fuck over brace lawsuits (users admit they have SBRs in need of registration), fuck over suppressor approvals, and fuck over current 1 year transfers to forever. I bet eForms crashes on the first day and is down 95% of the time within the feed-trough period. |
