If Orcas have eaten people, they've done it where there were no witnesses.

There is a video that came up after this one ended where an orca (actually 2) eats a man on the beach. It didn't look fake to me.

How does one establish the culpable mental state of an Orcinus Orca?

Chewing and swallowing.   Or biting hard enough to sever limbs.

This has not ever been documented.  

Prove otherwise.

There is a case where they attacked and ate a moose that was tangled up in a kelp bed in Alaska

I saw a pod of Orcas throw a blacktail deer back and forth for 15 minutes or so. It was alive until it wasn't. Eventually it broke into several pieces and the Orcas swam away. Deer was trying to swim from one island to another during the rut. They could throw that deer at least 30 yards without trying very hard.

I do remember a documentary where a group of KW's where attacking a boat by repatedly ramming it.
