Don't know that it's going to stop until some direct penalty accrues to the police department or the individual officers (depending on what they do).....
Maybe a case were a seizure of money is based on no real evidence (like this one)....and if the plaintiff can prove no probable cause for the search, no ties to drugs, etc....and the money is returned (as in this case)...the police department is made to pay the plaintiff's legal expenses. Out of their budget. No increased budget requests, etc. I'm betting the questionable seizures would drop off pretty quick. They can still seize stuff...but if they can't show a direct connection to illegal activities pretty damn quickly...they should return the money promptly.... AFARR |
