First off, Caetano flat out quashed this type of reasoning, but even pretending that ruling doesn't exist: 1) If 24 million ARs are not common enough to be considered common then nothing is. You might be able to find a few models of guns that had more made (or not? I can't think of anything offhand more prolific) but the order of magnitude would be roughly similar, therefore the logical conclusion of that argument is that ALL firearms are unusual. 2) Unless a manufacturer could magically produce and distribute whatever insanely high number of firearms they would consider to be "common" overnight, their interpretation means nothing new could ever be considered a protected arm. |
