I am sorry to hear about your situation. It is well known that it is "ordinary people" who often get leaned upon when the Feds want to make a case. I certainly think your limited tenure and responsibilities made what happened to you inappropriate. I can also understand that a job might not have been quite what you thought it might be when As far as your testimony, I expect that it related to the knowledge and intent of those at the company. I think it would be hard to use such testimony against customers unless there is a recording of you speaking to them. |

Quoted: I don't care how I look anymore. If I did I sure wouldn't post on it. I don't like what happened at all. nuff said I guess I could go on and on but without being able to tell my whole story everyone will always think I'm benedict arnold What can’t you tell that you haven’t already? |

Quoted: Posting this sentence on this site was a terrible idea. Quoted: Quoted: Two things: ATF and DOJ AUSA'S consider solvent traps silencers based on my testimony. We both know the Feds already considered it to be whatever they wanted it to be. It had nothing to do with Nick. It’s easy to tell the other guy to fall on his sword. A little more difficult to do it yourself. He’s a middle class American that had the wait of the US government against him. |
|
Quoted: Did the solvent traps work good for their intended purpose of trapping solvents? In the plea agreement, the defendants all agreed the purpose of the solvent trap was to secretly sell silencers without following the law. Therefore, the intended purpose was to be silencers. |
|
Quoted: I may be confused but wasnt DM working under a previous ruling or communication from the ATF that parts (especially undrilled baffles, end caps, and random threaded tubes) are not suppressors? Was DM selling more than that? People filed\received form 1s and made silencers with those traps\parts. Those people emailed DM, with info to improve traps\parts for form 1 use. DM made those improvements. People continued making Form 1s. ATF came out with interpretation; any part or combination of parts used or intended to be used in manufacturing a silencer is a silencer. Everything, in and of itself, is a silencer. |

So did you have 100% unaltered solvent traps at your house, or illegal silencers? If you had unaltered company products, did you tell the ATF you planned to convert them to illegal silencers and charges stemmed from that? Just looking for some clarification of what you were being accused of, I'm being too lazy to look it up in our database. |

Quoted: Here's how the system worked for me. Couldn't afford a real attorney besides my father who is one but not federal and out of state and on his advice got a Federal public defender who on my first contact call with him told me I'm guilty.. Agreed to all that ASUS wanted.. I was on pretrial probation release. with my house as collateral $10000 bond. Your basicly on probation without being on probation they won't call it that but you gotta report. I didn't know this until I had to do it such BS basically convicted before being convicted.. Outcome 50% reduction in sentence for cooperation no prison time and can move on with my life if I complete my probation with no violations(which can be made hard if you have someone who may want you to fail) Federal sentencing guidelines offer ridiculous incentives for cooperation and guilty pleas. In effect, one is punished for asserting one's innocence. Also, if you do not have an attorney that is interested if fighting for you, you are screwed. Most here would not understand that. |

I don't like what happened at all. nuff said I guess I could go on and on but without being able to tell my whole story everyone will always think I'm benedict arnold So you come onto a public gun forum, admit the feds shook you down enough that you ran your mouth about how no, these are suppressors, helping the feds out so they can bust down American citizen doors, then you further go on to say you can't have a gun anymore... We had a disagreement over the phone. I've been a standing member for years have over 145 Positive feedback on ebay and also positive feedback as a weaponsguild member. It wasn't even a complete deal. Quoted: What happened with the negative EE feedback from June of 21? |

I get the Feds and their bullying but unless DM had company documents and recordings saying "hey were are intentionally circumventing laws" a decent lawyer should have been able to get them off. I get that you get punished for the fight, but I am still confused here, especially on how the OP went down. Too much missing information. If they were selling pre-drill baffles along with the emails you mentioned - I can see them toeing the line, but otherwise this is just a bunch of continued fuckery from the Feds. |

Quoted: So it was cool working for a company that was trying to sell a legal product in accordance with the law that poked the bear but once the man came at you you became their snitch? Thanks for your service to our ATF overlords I guess. Do you have the money to hire a high powered attorney to fight them for probably years? And take the risk of a federal prison for the rest of your life? Or would you agree to a plea deal they wrote and forced on you that would allow them to prosecute others? |

If i said what I want to scream at all of you i'd be: A person convicted of under federal law may face up to five years in prison and fines. The punishment for under state law varies from state to state, but is a felony and carries a possible prison sentence of at least one year, plus fines and probation. another charge.. :( please fill in the lines on what someone in power could convince someone to do with extortion.. like 1000's of "silencers" hell my federal sentancing judge had no doubts they were silencers it's insane he saw the damn picture of what we sold. They just go along with it.. Quoted: What can’t you tell that you haven’t already? |

He was convicted of conspiracy (to violate federal gun law). |

I mean, I have multiple spreadsheets with data compiled from as many posters on the site that time has allowed. Just haven't put it all into a viable, searchable database yet... ...some of y'all do this too, right? |

I had altered ones and un altered ones as well as machine guns. I had said "illegal" machine guns for 20 years.. I never hurt anyone it was just my view that any violation was an illegal order just like in the army if a officer gives you an illegal order you don't follow it. That didn't work out real well for me but that's how far down the 2A rabbit hole I went. I will say they are having trouble dealing with ST's (solvent traps) because there are so many people calling them ALL the time. NON-COMPLANCE on a mass level = how to get rid of the NFA. Just like with weed for the druggie people(no offense to those folks i didn't do that.. you do you) The problem is it will take way more than a village and for people to openly come out instead of waiting for them to reopen the registry.. OH and btw I know lots of people with stuff but I aint gonna be telling anyone about it ... It's actually something in my probation agreement that says I cant.. :) $$$$ worth of my guns were destroyed.. mp5pwd UMP45 240BRAVO Sten UZI Quoted: So did you have 100% unaltered solvent traps at your house, or illegal silencers? Quoted: What did they have on you that coerced you to give a testimony that that made solvent traps be considered silencers? Is the firearms conviction for the possession/selling of solvent traps turned silencer? Sounds like sending him to prison for 40 years was the threat. Having never been in position to do life in prison, I can’t judge OP. Insurmountable odds. Eta: well, After OPs last post he’s just a criminal who snitched on everyone. There was certainly more to the story, regardless if you agree with machine gun laws or not. |

Quoted: "ATF and DOJ AUSA'S consider solvent traps silencers based on my testimony. " They can "consider" all they want but it it the legislation that matters. Has any owner of a solvent trap ( un-modified ) been convicted of possession of a silencer ? Regarding your testimony - if you admitted INTENT to commit an offense relating to silencers - I cannot help you. But your intent does nothing to show the intent of anybody else in possession of a solvent trap. This... Are you a legal technical expert? if so what qualifications do you posess? I could say "im god, you all do what i say" in court, it doesnt make it so unless ive got some backing(a lightning bolt shooting hand, halo, and water walking son) |

I knew it was more than just the solvent traps. They were looking for a way to leverage someone into that testimony. They found this guy with unregistered machine guns and now everyone else gets to deal with it. |

I agree there's a lot of missing pieces here but I think you're underestimating the federal system. To complicate things further, it may have been the only way for a father of young children to guarantee a non-prison resolution. |
