I sent my form 1 over 2 weeks ago. I came across one supplier that currently have the 10.5 inch upper that I want "in-stock". I am so TEMPTED to buy this now. But I must resist. Or.... I can pay for the item now and ask the supplier to hold it for me until my approved Form 1 comes back.

I just don't want to wait for this same upper to show up; if I let this one go.  height=8

How does one do it for a non-AR?  Do you order it, and then it stays at the dealer until the paperwork clears?  I mean, if it's a complete weapon you can't just get the serial before you buy it, so how does it work?

First thing you do it figure out who you want the NFA item shipped to, your local class III dealer.  This is a crucial decision because your NFA toy will have to sit there for awhile and you need to trust this class III dealer.

Purchase the NFA item and have your class III dealer fax their class III and SOT to the vendor.  The vendor will initiate the form 3 and send it to the BATFE, this will allow the transfer of the NFA item to your dealer.  When you dealer gets it in, then you start the form 4 paperwork.

I assume I would get it engraved before I pick it up then, or do some manufactures engrave it for you when you order it (I'm thinking of a 12" XCR)?  OR would it be easier to just get a 16" XCR now, and then get it SBR'd later?

If you are purchasing a factory SBR, which I think you are, they are already registered so no engraving is required.

Just want to give you folks an update. I sent my Form 1 to BATFE in WV on 05/07, certified mail with return receipt. I got my approved Form 1 today 06/07 with the tax stamp. I say 32 days is FAST!

What are you guys putting in 4h "State why you intend to make firearm" ?

Would it be ok to abbreviate my location when engraving?

ex: WPB, FL as apposed to West Palm Beach, FL

new to forums and planning on my first sbr build soon. all this information is incredible and thanks so much to all the posters. after reading 27 pages i'm dizzy and lightheadedher. It appears to me that all these rules/regulations serve only to try and confuse and make criminals out of law biding citizens because of some technicality - what a joke!

also, i know it seemed to be a problem a few yrs ago but was wondering if anyone has used the <16" and <26" on the form lately.

I sent in two Form 4's at one time for two suppressors, and only included one set of fingerprint cards and one citizenship form. The transfers went through NO PROBLEM.

Ok say I want to SBR my AR as a 10.5" is there anything saying that I can't put on a shorter upper later? (For example a RRA upper with a 5" 3 lug TROS barrel with a 7" YHM free float handguard.) Are the measurements on your form 1 the minimum that your SBR can ever be? I see that people send letters to ATF saying I might use a 5.56 14.5", a 9mm 10.5", .22lr 12", etc.

You used to be able to put "Less than 16 inches" and be good to go, but the last I heard, the BATF had cracked down on that practice. The good news is that you can list the barrel length for the upper that will reside on the SBR the most, and switch to any lengths (longer or shorter) afterwards.

I put "collector of firearms". Been approved twice. I have seen others that have put "for all lawfull purposes" That goes through as well.

For abbreviations, I personally would stick to well known abbreviations for cities. PHX for Phoenix, ATL for Atlanta, NYC for New York etc. If WPB is a well known one for West Palm Beach, then go ahead.

In 2006 i did a SBR through a gun shop.He did the paper work and for barrel length was 10-24,and for overall he put 16-48 and it went through.I'm now trying to do one myself since the gun shop has left town and for this one i'm following that guide line by putting 5-16 barrel and 24-36 for overall and have no reason to think thats not going to work.

From what I've been reading it will get sent back to you for specific barrel length and OAL.

Can anyone please tell me when you drop off form 1's to, in my case the Sheriff do you also include the citizen ship form,and do you have to include also a return adressed envelope.Please,thankyou.

Here in my town, you walk in and get the two forms signed, and walk out. I've never had to leave them and have them mailed back to me. I guess I'm lucky.

In oregon you leave it atleast in my county,no matter i just dropped it off with two form 1's with photos attached and one citizenship form,I'm going to take a leap of faith and assume at the local level if i sent to much it wont be a issue as it will be when sending stuff to the feds if you dont get just right.

The CLEO doesn't sign the citizenship form, so no real need to drop it off with the Form 1's.

As an LLC, you should have the following in the envelope you mail off:
2 Copies of your Form 1 (printed double sided)
1 Citizenship form
1 Copy of Articles of Organization for your LLC
1 Check for $200 made out to Department of Treasury

Yes.

NFA FAQ, arfcom NFA sticky

Old forms can get your application kicked back.  If the signature line for the NFA examiner is not on page 1, they have been kicked back to the sender.

No return envelope required.  The best way to ensure you have the correct form is to call: 304-616-4500, or order from the ATF distribution center order form - it's free and fast.

Holly cow, I just finished reading all 28 pages of this thread. Thank you all for clearing up a bunch of things. I wish I would of read this info before even dealing with the B.A.T.F.E. This is what I went through. First I went to their website to try and get form#1. Their website is far from helpful and when I finally found the form to download, it would not work. I finally gave up on that. I live in Topeka,Ks and found an A.T.F. office phone # in Topeka, no one home. Next I called a govt. help line for an A.T.F. phone # They gave me the Wichita branch. I called them and they referred  me to the W.V. branch But he said they probably would not answer the phone so he also gave me the Kansas City branch Phone #. Well W.V. didn't have anyone available so I called K.C. I finally got a hold of someone that I thought was in the know. I told him I wanted to build a sbr, he said you need a form #1, I can mail it out to you. I said great, so I just need to fill it out, get my CLEO to sign off, put my pictures on and get my fingerprints done...right? He said no, you don't need finger prints for an sbr. Then he said hold on let me make sure. I waited about two minutes and he got back on the phone and said no, you do not need fingerprinted for an sbr. Well after reading all 28 pages of this thread I believe he is wrong. I hope he sends all the correct paperwork. I really want to build this thing. Man I wish they could all get on the same page. Wish me luck.

Well I figured out why the ATF website order page wasn't working, It was because I was using Mozzila as my web browser. I tried Explorer and it worked perfectly. I got my form #1's, citizenship and fingerprint cards ordered. I probably never would of figured out how to get through this mess if it were for all the good folks here.  Thank You!

For those thinking of listing barrel length <16" and a range for overall length, I just received my form back with a note to list the specific length for both and re-submit.

Hopefully the wait the second time around will be a little shorter.

I still have a question about the lower to be used.  I read in the posts that it has to be a pre-ban, and then on others it can be post ban.  what is it?  I want to have everything i have now on my AR (collapsable stock, 30 round mag, threaded barrel, eventually a silencer etc. etc.) without having to find a pre-ban lower.
so whats the deal?

Unless you live in a ban state that allows SBRs, you can use any receiver you want.  The pre/post ban issue died with the AWB on 9/13/2004.

I was wondering about a cheaper workaround... instead of registering each additional AR15 rifle lower in your possession, could you instead buy stripped pistol lowers (marked as such) for each of your extra SBR uppers?  

So you would possess 1 registered SBR lower, several non-SBR lowers, and for any other SBR upper in your posession, you have a corresponding stripped pistol lower, which makes a legal pistol assembly, should you decide to assemble these lowers into functioning pistols.

Or would these pistol lowers need to be fully assembled?  Or assembled once as pistols and stripped back down?  Or would you need the remaining pistol parts in your possession as well?

I mean, if I'm going to purchase a second barrel for my SBR'd lower, it sounds as though just having a second barrel would put me in violation if I have only 1 SBR'd lower, but additional non-SBR'd lowers, so would a pistol lower be cheap insurance, short of registering my additional lowers?

Just a theoretical question...but a stripped pistol lower at $80-$100 is a bit cheaper than the registration process for non-SBR lowers you may possess, and since the ATF appears to like hanging people up on technicalities, is this a technicality that could be in our favor?

Has anyone gone this route, or asked the ATF for a ruling on this?

ETA: or does the AR pistol lower need to be registered as an AOW, which sort of negates the whole point?

ok i have a question on the age part. i live in indiana, and am 19. im really wanting to build my reciever into a sbr, but i want to know if it is legal for me to in my state. is there a website that will tell me if an sbr is legal in the conty i live in? also, does anyone know of a website that will tell me if i can apply for my for my tax stamp with me only being 19? im really new to this and am looking for a lot of help. could anyone direct me on how to begin the process of filing my f1, as far as who i need to speak to and what questions i should ask?

Run-n-Guns,

SBRs are legal in Indiana.  Note that short barrelled shotguns (i.e. barrels of less than 18") are not legal in Indiana.  I don't know the answer to your questions re being 19.
