Is this the Thordsen Device?  They have a letter from way back from AFT that said their device was not a "stock".  They have asked for additional clarification in light of the new rule but as of a couple weeks ago hadn't received a reply.

Does the classification change, if it's a pistol tube vs. a rifle tube?

AFT has indicated that any device that houses the buffer that is longer than necessary for function of the action would be considered an "aid to shouldering" and verboten.

A 6 - 6-1/2" length has been tossed around as the propper "legal" length for a round "pistol" buffer tube.  

The standard adjustable buffer tube that your brace is currently attached to is fine as is and doesn't need to be replaced, however.

God I hate these changing laws.

Nope.  Fortunately I submitted early and got the denial in 3 or 4 weeks. I was told to re-submit from scratch and include the old control # in the digital documents train stop. I re-submitted with a photo of the barrel roll marks (and the rejection control # page) and it was denied again for the same reason (~5 weeks from re-submission), so I re-submitted a third time with the calibers matching, so I'm sure It'll be months out before any approval.  I have the same caliber (5.56mm) barrel on another registered and stamped SBR, so I'll jump through their hoops.

Ironically, I have another early approval with the calibers not matching.  So, to me, that says it is reviewer discretion on denials.  This whole thing is a train wreck.

My PSA to everyone is to make sure everything matches, as my approvals are all over the place. If my denial came after May 31, I wouldn't be able to fix it and would have to pay for the stamp.  This is not a normal Form 1 process.  You do not get an opportunity to correct, it is a denial and you go back to the end of the line and start over.

I agree, as my Multi's are not having any problems getting approved.  My advice would be to not upload a photo if the lower isn't marked MULTI. Unless you have some weird lower that isn't in the drop-down menu.

I have received 2 approvals for Bushmaster 223/5.56 marked lowers with 300 specified as the caliber during this process :shrug:

Yeah I don’t want to do it either but I’m still waiting on 2 of them so I guess we’ll see what happens.

It’s still stupid that only some of them that were submitted on the same day have come back yet weeks later the others are still MIA.

Okay, so I am over this crap with the pistol. At 66 years old I don't need to waste the money doing the trust thing so my son can get the AR. He isn't even interested in shooting. He bought a Ruger(?) AR from Rural King two years ago and hasn't put sights on it never mind shoot it. I have a POF Edge 415 pistol and I am going to buy a POF Edge 415 upper for it which has a 16 1/2 inch barrel. I know the OAL has to be 26 inches. How do I go about getting this straight with ATF. I have the eForm submitted but not approved.

He can inherit your AR anyway.
It doesn't matter if it's registered individually or in trust. If it's willed to him, he'll still inherit it tax-exempt after your passing.

My kids are in my will for one firearm each. The remainder are willed to said son. The firearms are not list by name to him. Actually all my wife's remaining stuff is going to him. So then becomes the question if raised by the ATF what proof does my son have since he doesn't have a stamp since the AR is specifically listed in the will?

I appreciate your help.

For all NFA items, you should specify the recipient in your will. The executor of the estate will complete an ATF Form 5 for the tax free transfer. This is covered in the ATF handbook, section 9.5.3.1 and the backup is below.

If you put on a 16" upper, the item is no longer considered a SBR while it remains in that configuration. You can travel with it, sell it, or loan it to someone else without any requirement to notify the ATF at all. I concur with what was already said above. I'd just let it go though as it's costing you nothing, so you have complete flexibility.

I went the Silencer Shop route as well. They had a recent picture on file and my electronic prints. I am four days shy of one month since submitting. Not a peep from the BATFE.

I can't remember where I saw/heard it but 125,000 is the last recent figure. This may be from Dettleb*** in front of Congress. Of course, you're getting this info on the interweb so its worth what you're paying for it.

If you call or get on chat as soon as they open, it's much better. Try calling or chatting in the middle of the day, it will take forever, if ever. They open at 9am central time. Call right then and you should have better luck.
