Big 2A Win | New Jersey Assault Weapon Ban Stuck Down
Late this past Friday, the US 3rd circuit court of appeals dropped a huge decision finding not only that New Jersey’s so called “assault weapons” ban and other restrictions on things like standard capacity magazines was found to be unconstitutional in a 10-5 decision.
Among the 10 judges that had the sense to shut the decades long tyranny experienced in her area was Arianna Freeman, who despite being a Biden regime appointee, had more of a based take on this than most alleged “gun advocates” in red team seats. She stated in her opinion that not only did these bans fail to meet the historical tradition of firearms regulation as established by the Bruen ruling, but that the courts should not deviate from this legal philosophy even when “these regulations are passed with the intent of reducing gun violence” with intent doing a lot of heavy lifting in that statement. This objective application of legal analysis was incredibly refreshing to see in 2026 and I applaud her for taking her oath to uphold the constitution with conviction and courage. But what does this mean for the folks sitting behind enemy lines?
Well since this was a split decision this will fall into the purview of the highest court of the land (which is looking like a good thing for those of us hoping for more 2A victories). We should be getting a ruling in about a year on similar cases out of Cook County in Illinois and out of Connecticut with oral arguments happening in the next couple of months in those cases.
We are, despite all of our gumblings and half fulfilled promises by our current administration, on the cusp of getting all 50 states on the same page of what “shall not be infringed” means and providing opportunities for people living behind enemy lines to get access to arms we in the free states never lost.
