New York "Vampire Rule" Gets Struck Down in Federal Courts


New Yorker gun owners, for once, have something to be excited about. The second circuit federal court of appeals permanently struck down a provision of the “Concealed Carry Improvement Act” that prohibited firearms possession on private property and public amenities usually open to the public.


The CCIA was in retaliation to the landmark 2022 case of New York State Pistol & Rifle Association v. Bruen where the Supreme Court struck down the need for CCW applicants to show “proper case” to obtain a permit to carry.


New York’s response to this reduction in their power was to try and turn all of the places people go into “protected spaces”, thus creating the so-called “vampire rule” where you have to be given express permission to enter with a gun. The result of the appellate case win, is that in an attempt to turn the floor into lava and not allow permit holders to go anywhere with their gun permit, we have successfully uno reversed them and secured the default to all places, open to the public, as good to go for permittees to carry concealed in those places unless adequate notified they can’t by an owner.


Though there are still federal laws that allow for sign postage outside of a privately owned business or property to prohibit concealed carry (which affect even the reddest of states), this is definitely a step in the right direction for folks behind enemy lines.


The Second Amendment Foundation, Firearms Policy Coalition, and Brett Christian are all to thank for moving the needle towards actual freedom for New Yorkers and I highly recommend supporting the people actually suing for our rights against tyrannical government entities.         


 


Maryland Bans Glocks


Back in January, Maryland Senators Love, Smith, & Waldstricher, introduced Senate Bill 334 which aimed to ban any “machine gun convertible pistol”. Now what qualifies as a machine gun convertible pistol?


According to the bill’s definition, “any semiautomatic pistol with a cruciform trigger bar that can be readily converted by hand or by using common household tools into a machine gun by the installation or attachment of a pistol converter as a replacement for the slides backplate”.


 


In short, Glocks and Glock clones. Now why would a state decide to go out of their way to ban the gun when the conversion kits and possession of the machine gun versions of these pistols are already universally prohibited? I think they just wanted to find a way to ban one of the most prolific pistols on the market. Worse, you are one DIY video or STL file away from other non Glock esk pistols being banned under the same law. Did blue team Governor Wes Moore care that this has the potential to disarm the residence of Maryland? Heck no, and as of the 26th he signed it into law which will be effective as of January 1st of 2027.


The Second Amendment Foundation has already promised to sue Maryland over this clear constitutional rights violation and hopefully for the residents of Maryland there is some injunctive relief in their near future.

This limited edition replica is a 1 to 1 of the rifle that, though it ended up losing to the M14 in the US trials, would eventually become the “right arm of the free world”. I’m stoked to see repros like these and hope they do more in the future.
