I was just researching the NICS checks by state. It's been discussed in GD how Kentucky is leading the nation. http://www.fbi.gov/about-us/cjis/nics/reports/state-totals_1998-2010



Then I came across this information. The source might suck but they quote an FBI spokesman and I would assume he knows what he is talking about. I know if we have a CCDW we don't have to go through a NICS check but I had never heard that the state runs a check on everyone with a CCDW every month. Anyone know anything about this?

Gun sellers in the Bluegrass State, which has just 4.3 million residents, generated almost 2.3 million instant background checks in 2011 - accounting for roughly one of every seven the FBI processed during the year.



But But FBI spokesman Stephen Fischer said Kentucky's numbers were distorted because the state runs a fresh background check every month on gun owners with state-issued concealed weapons permits.

My local dealer, that seems to stay pretty well knowledgeable on these kinds of things, told me the state does do a NICS check on CCDW holders every month. He said this is a big reason why permit holders don't have to do a background check when they buy a gun from an FFL in state. In many states permit holders still have to do a NICS check when they buy a gun because the BATF-E has deemed that states permit system (or more importantly their method of identifying those that should have their permit revoked) were not good enough. By doing the monthly NICS check, KY can identify those permit holders that may have committed and offense worthy of permit revocation in another state.



I have no problem with this.

I don't have a problem with it either, especially since we don't have to do anything and it isn't costing permit holders anything.  I was just curious as to where it came from.  Was it part of a law that was passed, an administrative ruling, or did someone just decide to go ahead and start doing it.



According the ATF it looks like 50% of the states have an exemption from NICS for permit holders.

Kentucky seems to be the only state running monthly NICS checks.  I would assume the other states that have the exemption are running some sort of state level background check.

When doing a FTF gun deal, if that person has a KY CCDW, you dont have to worry about if your selling to a prohibited person.

I'm guessing there are two different sets of regulations for the state police and they have to follow procedure.  The CCDW law was around long before whatever program the ATF created for allowing exemptions to the NICS check.  So the laws for application and renewals is different than the requirements they have to meet the ATFs program.  I'm also going to assume that Kentucky is using the NICS check because it is a free for the state.  It shifts the costs of the background checks to monitor CCDW holders from state resources to federal resources.



Another question that I have, hopefully there is an FFL here that can answer it, every time I've seen a dealer call in the NICS check they give the serial number and category of the firearm.  We know they keep NICS records even though they aren't supposed to.  So does it appear to the ATF that every CCDW holder in Kentucky is buying one gun a month?  If so, what gun is recorded that we are purchasing?



Yes I'm bored and find this type of stuff sort of interesting.

It doesn't really bother me either that Kentucky does this.. I just kinda wonder if they do background checks on people like myself who are FFL holders as well as CCDW holders..

Or simply put - I wonder if they do the NICS check on plain FFL holders monthly??

FFL is a Federal thing and I doubt the KSP would bother since they have no reason to do so. They probably don't even have a list of FFL holders in the Commonwealth.

it is funny that people don't know they are being checked up on. they are not going to check you once at the beginning of 5 years and not check you again

When a person  is called in to NICS, you do not give the serial of the gun.The only thing they ask is type,handgun,longun,other. No serial,no caliber,no make.
