Please help a new ARFCOM member. I live in the city of Denver and am looking for some help in understanding the local laws regarding "assault weapons." I really would like to get an AR-15 but it is my understanding that all AR-15s are banned. Is this true? From what I have been told the closest I can get in Denver is to have a ruger mini 14 with 20 round mags to still be legal.Any input is greatly appreciated

Yep, ARs (and several others) are banned, as are magazines that hold 21 or more rounds.

Move to the 'burbs if possible.  We have what you want.  

Here is the relevant section of the Denver code:



Sec. 38-130.  Assault weapons.
...
(h)     Specific prohibited assault weapons.  It is unlawful to carry,
store or otherwise possess within the City and County of Denver any of the
following weapons which are hereby declared to be assault weapons except
as provided in and subject to all the provisions of this section:

     (1)     All of the following specified rifles:

            a.    Norinco, Mitchell and Poly Technologies Avtomat Kalashnikovs
                  (all models).
            b.    Action Arms Israeli Military Industries UZI and Galil.
            c.    Beretta AR-70 (SC-70).
            d.    CETME G3.
            e.    Colt AR-15 and CAR-15.
            f.    Daewoo K-1, K-2, Max 1 and Max 2.
            g.    Fabrique Nationale (FN/FAL, FN/LAR and FNC.  [sic]
            h.    FAMAS MAS223.
            i.    Heckler & Koch HK-91, H-93 [sic], HK-94 and PSG-1.
            j.    MAC 10 and MAC 11.
            k.    SKS with detachable magazine.
            l.    SIG AMT, SIG 500 Series and SIG PE57.
            m.    Springfield Armory BM59 and SAR-48.
            n.    Sterling MK-6 and SAR.
            o.    Steyr AUG.
            p.    Valmet M62, M71S and M78.
            q.    Armalite AR-180 Carbine.
            r.    Bushmaster Assault Rifle (armgun).
            s.    Calico M-900 Assault Carbine.
            t.    Mandall THE TAC-1 Carbine.
            u.    Plainfield Machine Company Carbine.
            v.    PJK M-68 Carbine.
            w.    Weaver Arm Nighthawk.

     (2)    All of the following specified pistols:

            a.    Action Arms UZI.
            b.    Encom MP-9 and MP-45.
            c.    MAC 10 and MAC 11.
            d.    INTRATEC TEC-9.
            e.    Mitchell Arms Spectre Auto.
            f.    Sterling MK-7.
            g.    Calico M-900.

     (3)    All of the following specified shotguns:

            a.    Franchi SPAS 12 and LAW 12.
            b.    Gilbert Equipment Company Striker 12.
            c.    Encom CM-55.

     (4)   Other models by the same manufacturer that are identical to
           firearms listed in subdivisions (1), (2) or (3)  except for slight
           modifications or enhancements, including, but not limited to, a
           folding or retractable stock; adjustable sight; case deflector for
           left handed shooters; shorter barrel; wooden, plastic or metal
           stock; larger clip size; different caliber provided the caliber
           exceeds .22 rimfire; or bayonet mount.    

     (5)   Firearms which have been redesigned from, renamed, renumbered or
           patterned after one of the listed firearms in subdivision (1), (2),
           or (3) or those described in subdivision (4), regardless of the
           company of production or distribution or the country of origin or
           any firearm which has been manufactured or sold by another company
           under a licensing agreement to manufacture or sell the identical or
           nearly identical firearms as those listed in subdivisions (1), (2),
           (3) or those described in subdivision (4) regardless of the company
           of production or distribution or the country of origin.

(i)     Specific magazine prohibited. It shall be unlawful to
carry, store or otherwise possess a magazine which will
hold or may be modified to hold twenty-one (21) or more rounds.

So, a Bushy Varmint is illegal as far as Denver goes? Thats screwed up! You can go down to any store that sells them and pick one up, but the minute you bring it into Denver it is "illegal." What a load of crap! I am glad I live in the burbs.

Am I reading that correctly?

I think so. Looking at the wording of the ban posted above they would be able to nail you with bushy varminter as it is a clone of a AR-15 . I was alos thinking about an AR-10 but saw the part where it doesn't matter if the caliber or manufacturer is different.

When did this go into effect?  I remember the junk guns/saturday night special restrictions and the 20 round mag limit, but not anything about assault weapons.  I thought that they only won part of the case, mag limits, no sat. night specials, no open carry, and no car carry without valid CCW?

Interesting, considering I live in BOULDER and my Kalashnikov is completely legal.   Who'd a thunk that an even more liberal, gun-hating area allows her.  

Folding stock, bayo mount, 30rd mag, pistol grip....I'm surprised that after I bought it that it didn't head for the nearest elementary school.

The wording in the laws has always confused me. I have an american made shot gun that I modified. I changed the butt stock to a pistol grip then added a section on to the magazine to hold a few more rounds. I think it makes for a good home defense firearm, but I don't want to end up in jail for it. Is this thing legal or not?

I live in Denver and bought an ar-15 two years ago. The gun shop who sold it to me told me if I'm caught with it, I will get my ar-15 taken away and it will be a misdemeanor.

I had my question answered when I went to the gun show this past weekend. Dave's Guns was selling a setup Just like mine for about $225 and said Denver allows that type of shotgun.

Don't confuse the college students with the real money townsfolk that make the city run.  In Boulder, the wind changing directions is about the same as the voiced social attitudes in regards to the student’s population viewpoint (read voiced all it wants, but doesn’t go any where if it screws with the money).  You have to remember that in the late 70's, boulder was the home of SOF with a heavy mercenary population, and if you get far enough out of town, still is.

Bottom line is the FBI still recruits from CU, the college is heavily government funded for research, and as for a city being so healthy, it's surrounded by the some the most toxic crap known to mankind. Rocky mountain arsenal to the south, the old birth control plant to the east, and Beach air craft/Raytheon to the north, and if you count the Boulder reservoir ground table contaminations from the west, there is nothing healthy about the town at all.

Don’t know how long you have lived in boulder, but the old joke was if you wanted to know something real about the town (not just the fluff), you had to read it in the Denver post, and not the Daily Camera.  Funny part now is the same company owns both, and nothing bad about the town ever gets printed altogether.

Grrrrr. . .  so this applys to those of us that Use I-25 to get down south? even just passing throught? Wow I guess its the kinda of thing I would have expected  in hippytown USA but denver? guess Im looking for a new way to go shoot with my Brother In  C.

So what does this do if you LIVE somewhere else and Travel Through Denver?  Like you live up north and travel to the springs for some shooting with your NFA items or AR/AK items??

I think the Denver home rules would still apply.    I sure wouldn't bet against them.
