Heard the non-ruling by SCOTUS today on affirmative action and I have to wonder if this is going to be a new trend of punting on controversial issues.  I have to wonder if they might not be in the same mood to punt on Second Amendment cases too.  This seems in line with their rejection of the Kalchasky appeal.

Exactly!  We still have to wait until the end of the week for the remaining "big" cases but I get this feeling the Supreme Court would rather keep pushing stuff down to the lower courts and leave well enough alone.  There are no Second Amendment cases currently awaiting decisions but it seems troublesome that more and more the are issuing extremely narrow opinions (or none at all) which are solving nothing.

I have not read it, but based on the reports they said the Circuit applied the wrong standard. The implication is that the Circuit will apply the right standard and reverse itself, without it becoming a national precedent.

So yes, a bit of a punt.

The more I read about it, I am not sure they side stepped it. In fact, it seems like a good pro-business/anti-government intrusion decision.

I concur with my Learned Brother, strict scrutiny would be a Godsend if applied to the 2d Amendment.
