Let me preface by explaining that although my post count is low, I read the HTF frequently.  

I figured I would seek the advice of the hive on this one.  There is a piece of property for sale in the eastern part of Rensselaer County.  Both the seller and I are acquaintances through my friend who is an abutting land owner on 3 sides of his land.  We have met many times during previous hunting seasons.  He currently holds 405 acres and is looking to sell off 60 acres.  I have directly asked him to keep me in mind when he was ready to sell it.   However, I noticed a few months ago he listed it on the MLS and never contacted me or my friend to see if either one of us wanted to purchase it.  This is not he first time he has done this either.  
The question is how should I approach this guy regarding this matter?   I’m not sure if my friend pissed him off at some point or what.  But it seems like in my opinion he has an obvious bias toward downstate residents.  I made it known to him through direct conversation that my intentions were clear.  I will not be subdividing it or wrecking the place. I am just looking for a nice piece of land next to my friends camp so we can be abutting land owners.  My ultimate goal is to move my family there when I retire 10 years from now.  I love this state despite what the prince is doing to it.

I don’t to disclose specifics on location as I am not sure if he is a member here.
He holds a position as an elected town board official.  

Advice appreciated.   Criticism expected.

He prob. figures you want a "deal" because of knowing him and figures he can get more $ elsewhere.  Was it listed at more than you wanted to pay?

In my opinion yes it was.  Only a 100' ft of road frontage.  No utilities.  Hilly terrain. Just logged and heavy slash left over from logger.  61 acres for 99k
No views. No water.

He may also have a relative, friend etc. who is a realtor and felt obliged to list with them when he put the property up for sale.  I deal with a lot of realtors in my practice and some of them can be quite pushy in trying to secure listings.

I will inquire about it  when I see him during bow season if its still up for sale. Who knows.  Year is flying by.

Not what you want to hear, I know, but I would consider it a blessing.  I like this place too but I think I would prefer to spend my retirement someplace where I have rights.

We thought  about moving. However, the but part of it is that we have a young child. So schooling will be an issue. Also both my wife and I will have to continue to work no matter where we go.  She wants to go to North Carolina.  I want northeast.  NH or VT.

So you had it figured to pick up a chunk of land off this guy on the cheap because you talked to him a few times, you hunt next door and it didn't work out.  He decided to go to the open market and that bothers you why exactly?  I don't see the conflict myself.  His property/investment, seems like he should be able to liquidate it as he deems fit.  Doesn't sound to me that he made any promises to you right?  You mentioned interest in purchase if he decided to sell and it sounds like he didn't bother calling.

99k on 61 ac is far from exorbitant.  The days of sub 1k per acre are long gone over most of Upstate, even the most hilly, gullied, logged over piece of scrub commands value these days.

Contact the guy, make a fair offer if the land is something you want, or change your sight picture somewhere else...........

OP, this a blessing in disguise. Take this as a sign. You do not want to retire in NY. Think of milder weather, less of a tax burden. Ask yourself this- do you want to spend your hard earned retirement on property tax, high cost of living, all to have less rights than if you lived 90 miles southwest in say PA? I'm not saying move to PA by any means. But if you are thinking of moving, and not thinking of moving out of this state you are out of your mind.

Figure out how much he will lose to the listing agent and offer him whats left.  You guys talked about it before he signed so you can cut the broker out.  If he does not take it, oh well.  Who cares about what is going on in his head, it does not matter to you.  Offer what you are willing to pay and move on if hes not interested.

Visited the Scranton area a few years ago.  Clark's Summit to be exact. Other than that I don't know much about it.
