Hey guys, how does one go about becoming an LLC?

I have been operating as a Sole Proprietor for two years and it is time to separate my accounts and get set up to possibly have a payroll in the future.

I would like to transfer and maintain an account just for business stuff and just pay myself out of that account, that way all my personal finances are separated from work finances and I can tie retail accounts to it.

Also, I assume that it offers a certain level of protection from lawsuits that way.

Are there different types of LLC? Can I simply go to the county office building and change my DBA status or do I need some paperwork?

however llcs require publishing which must be in 4 approved by nys corps office usually around 350-500 bucks

if thats too steep do a S corp and file quarterly, speak to your accountant and find out costs and if that works for you.

My brother is a CPA and he always suggests S corp for little self starters with limited liabilities

I contacted a local attorney, I am waiting to hear back.

Why would an S-Corp be more beneficial than an LLC?

I really have no idea about tax law and such, my accountant does all that stuff for me, I just sign the papers.

look it up its not 350-500.LLC is pass through earnings-no quartley tax. S corp you have to file 1/4ly tax.

Do yourself a favor and stay away from Legalzoom.  I have reviewed some of their documents and they are crap.  Get a real attorney who understands NY Law.  You can do it yourself if you don't mind doing the leg work and research.

I have been using legalzoom for years without a problem.When we buy a property we start a LLC for each one can't tell ya how many we have done.I woiuld not even consider not using them.

i used legal zoom for llc, no biggie and it was onl half what a lawyer quoted me.  he told me to try legalzoom actually and save myslef some money.

that's about what it will cost from legal zoom, i did the deluxe and it was just over 700 (filing fees inluded in that btw).  my lawyer wanted 1500, plus all the filing fees, etc.

i let legalzoom be my registered agent, but that is a decision you have to make for yourself.

You act as your on agent and file yourself also.It will not cost 750.00. a liitle work on your own but big savings.If you need further help PM me and i will help.

You will also file for tax ID number on your own.If you can read and write which you can you can do it.
